THE CHILD PROTECTION POLICY(CPP)

DepEd Order No. 40, Series of 2012

OBJECTIVE

The objective of the Child Protection Policy of the DepEd is to promote a zero-tolerance policy for any act of child abuse, exploitation, violence,
discrimination, bullying and other forms of abuse.
POLICY OF THE DEPED

It is the policy of the DepEd to ensure that all schools shall be conductive to learning and for children to have the right to education free from
fear. Consequently, all children shall be protected from all forms of abuse and bullying to develop self-esteem and self-confidence. Schools therefore
advocate a positive and non-violent mode of disciplining children. Corporal punishment shall not be imposed on any child in school for the purpose of
discipline, training or control.

PURPOSE OF THE CHILD PROTECTION POLICY

The purpose of the Child Protection Policy of the DepEd is to provide special protection to children who are gravely threatened or endangered by
circumstances which affect their normal development and over which they have no control (Sec.2 Deped Order No. 40, S. 2012).

The Child Protection Policy of the DepEd is intended to ensure such special protection from all forms of abuse and exploitation and care as is
necessary for the child’s well-being, taking into account the primary rights and duties of parents, legal guardians, or other individuals who are legally
responsible and exercise custody over the child.

DEFINITION OF CHILD

Child refers to any person below eighteen(18) years of age or those over but is unable to fully take care of or protect themselves from abuse,
neglect, cruelty, exploitation or discrimination because of a physical or mental disability or condition.
TERM CHILD DOES NOT ONLY REFER TO MINORS

The term includes pupils or students who may be eighteen (18) years of age or older but are in school, person who are over 18 years of age but
are unable to fully take care or protect themselves from abuse, neglect or cruelty because of a physical or mental disability or condition.

PROHIBITED ACTS PUNISHED UNDER THE CHILD PROTECTION POLICY

The following acts are prohibited and penalized in administrative proceedings as Grave or Simple Misconduct depending on the gravity of the act
and its consequences, under existing laws, rules and regulations:

5. Corporal Punishment
6. Any analogous or similar acts

OFFENSE COMMITTED IN CHILD ABUSE

If the person complained of committed any of the prohibited acts under the Child protection Policy and it was established that there is a clear
intent to violate the same, he shall be liable for grave misconduct.
Misconduct defined as a transgression of some established and definite rule of action, more particularly, unlawful behaviour or gross negligence
by a public officer. The misconduct is grave if it involves any of the additional elements of corruption, wilful intent to violate the law, or to disregard
established rules, which must be established rules, which must be established by substantial evidence.

DEFINITION OF CHILD ABUSE

Child abuse refers to any acts of maltreatment of a child, whether habitual or not, which includes any of the following:

a. Psychological or physical abuse, neglect, cruelty, sexual abuse and emotional maltreatment;
b. Any act y deeds or words which debases, degrades, or demeans, the intrinsic worth and dignity of a child as a human being;
c. Unreasonable deprivation of the child’s basic needs for survival, such as food and shelter; or
d. Failure to immediate give medical treatment to an injured child resulting in serious impairment of his or her growth and development or in
the child’s permanent incapacity or death.

DISCRIMINATION, DEFINED

Discrimination refers to an act of exclusion, distinction, restriction or preference which has the purpose or effect of nullifying or impairing the
recognition, enjoyment, or exercise by all persons, on an equal footing, of all rights and freedoms.
DISCRIMINATION, HOW COMMITTED

Discrimination against children is committed when a child is treated unfairly or differently. A child need to be actually harmed, physically or
psychologically, in order to be discriminated against. They just need to be treated unjustly than other for some subjective reason e.g. race, sex, politics,
sexual orientation, gender identity or religion.

CORPORAL PUNISHMENT

Refers to a kind of punishment or penalty imposed for an alleged or actual offense, which is carried out or inflicted, for the purpose of discipline,
training or control, by a teacher, school administrator , an adult, or any other child who has been given or has assumed authority or responsibility for
punishment or discipline..
