WILL
THIS IS THE LAST WILL AND TESTAMENT made on the
Second Day of June Two Thousand Ten (02-06-2010) at Mysore, by
me, Smt.Rathna, aged 66 years, W/o Late.A.R.Anantharamu, Residing
at No.57, LIG House, Gangothri HUDCO Layout, Chamaraja Mohalla,
Mysore.
I being in sound mind and good health make this WILL out of my
own volition and without influence by any external or internal
influence.
WHEREAS I am the sole and absolute owner by title and in
peaceful possession and enjoyment of the immovable property No.57,
LIG House, Gangothri HUDCO Layout, Chamaraja Mohalla, Mysore,
measuring east to west 7.40 mtrs. or 22 feet and north to south 8.4
mtrs. or 27 feet with a residential building thereon. That I have
acquired the said property out of my own funds, under a sale deed
dated 27-09-1995, from my vendor Smt.C.V.Shakunthalamma, which
is registered as Document No.3137/1995-96, Book-I, volume No.4574,
at pages 42 to 46, in the office of the Sub Registrar, Mysore South.
That the Khatha of the schedule property stands in my name and I am
paying taxes to City Corporation of Mysore and exercising all the
rights of ownership over the same. The Schedule property is free from
all encumbrances.
WHEREAS now I am aged 66 years and now I am suffering from
renal failure but my overall health is good and capable of
understanding the material things. As life is uncertain, it is my desire
that I should make proper arrangements for possession and
enjoyment of my property while I am in sound deposing state of mind,
so as to avoid litigation and difference of opinion among my heirs after
my death, as such I am executing this Will. It is my last desire to see
that my legal heirs to share the property left behind by me peacefully
and as such I am executing this last Will.
WHEREAS I am married to Sri.A.R.Anantharamu and out of our
wedlock, we have got one son by name Sri.A.S.Anand, and three
daughters i.e. 1) Smt. Kusuma Prabhakar, W/o. D.Prabhakar, 2) Smt.
Uma Mahesh, W/o. Sri.S.N.Mahesh and 3) Smt.Pushpalatha, W/o.
Sri.Chethan Kumar. That my husband Sri. A.R.Anantharamu died
intestate on 29-1-2003.
WHEREAS all of my children have got married and my
daughters are looking after me with love and affection and catering to
all my needs. That my daughters alone are taking care of my medical
expenses and other requirements ever since from my ill health and
have spent sufficient amount towards my well being. My son is having
bad habits and not taking any care or interest in my welfare and has
not been supportive to me in any way and leading a wayward life.
Further he has spent all my savings amount and also lost the money
given to him by his father. As such I am not giving any share in the
schedule property.
WHEREAS my daughters are very cordial to me and I have great
love and affection towards them and it is my last desire that only my
daughters shall hold, possess and enjoy and share equally the entire
Schedule Property, after my demise.
NOW THEREFORE BY THESE PRESENTS I hereby give,
bequeath and demise unto my daughters, the schedule property, who
shall hold, possess and enjoy the same after my demise with all the
rights, title and interest and shall enjoy the rents, profits etc. After my
demise my daughters are at liberty to deal with the schedule property
in whatever manner they desire including the power of alienation.
Except my daughters, my son or his heirs shall not have any right,
claim or interest over the schedule property in any manner.
WHEREAS I have executed this WILL out of my free will, volition,
natural love and affection towards my daughters, while I am in sound
deposing state of mind, without any undue influence, coercion, fraud,
compulsion etc. Except my daughters, nobody shall have any manner
of right, or claim over the schedule property. This WILL shall come
into force only after my demise.
SCHEDULE PROPERTY
All that part and parcel of the property bearing No.57, situated
at Gangothri HUDCO Layout, LIG House, Chamaraja Mohalla, Mysore,
measuring East – West 7.40 Mtrs or 22 feet, North – South 8.40 Mtrs
or 27 feet, and in all measuring 62.16 square Mtrs, with a house built
thereon and bounded on the ;
East by : House No.160,
West by : Conservancy,
North by : Road,
South by : House No.58.
IN WITNESS WHEREOF, I, Smt.RATHNA, hereby declare that
this WILL has been prepared on the instructions given by me, the
contents of the will has been explained to me in Kannada language
and fully understood the contents hereof and being satisfied, I have
signed, executed and delivered this WILL on the day, month and year
first above written.

TESTATOR

and in the presence of the Testator and in the presence of each other,
