Data Privacy Act on Community and Cooperative Research”

Republic Act No. 10173 or the Data Privacy Act of 2012 is a very important act to
protect every person’s personal information. Identity theft and data breach have been an
alarming case when it comes to cybercrime offenses. It is a serious matter because it
could really affect one’s life. Having someone use your name or your image without you
knowing is frightening experience because you’ll just be surprised that you’ll be an
instrument to scam someone. You’ll face charges without you knowing it. We should be
careful in giving our sensitive personal information, specially on the social media
platforms and websites we often browse.

Researchers, although exempted to the provision of the data privacy act, must be
considerate enough in getting the personal information of their subjects. Atty. Eric Robles
explained that the consent of the subject is the most important one, without it, they cannot
perform the research and it would be invalid if they continue to use their information
without them knowing. I also learned that upon gathering information from the subject,
researchers must explain the purpose of the information they are about to get. There
should also be limitation where the information is limited to the data needed and accurate
to the study. After using the information, researchers should not disclose it to a third party
and immediately dispose it in respect to their subject’s privacy. There are also penalties
if they fail to follow the data privacy act and one of those is 7 years of imprisonment.

The webinar is really helpful for us because we’ll be having our research in our
third year. Also, it is a great way to raise awareness to everyone in the community on the
serious matters of cybercrime. Our world is emerging into digital technology and
information are gathered easily in just few clicks. Webinars like this could help us know
our rights when it comes to our personal information. We don’t want to be a subject of
fraudulent activities, so we better make sure to disclose our sensitive personal information
to those who are trusted. In any case that our name or image is used without our consent,
we are free to report it to the cybercrime offices. We, as a member of the community
should be aware of this issue because it is alarming, and it is really happening specially
now that everyone is in need. Some of the people commit identity theft or data breach to
earn money that is why we need to be extra careful because anyone can be a victim of it.
