APPLICATION FOR PROBATION

Comes now accused John Doe assisted by the undersigned counsel,


unto to this Honorable Court, most respectfully applies for probation
according to Presidential Decree No. 968, as amended by R.A. 10707, on the
following grounds:

1. That accused-applicant was found guilty in Criminal Case No.


12345-SP (15) to a lesser penalty of Violation of Section 12, Article II of
R.A. 9165, otherwise known as the “Comprehensive Dangerous Drugs
Act of 2002” in the Order dated August 16, 2018, and was sentenced to
suffer the penalty of imprisonment for six (6) months, and one (1) day to
one (1) year.

2. That accused - applicant has not begun to serve his sentence


aforementioned;

3. That Section 4, paragraph 3 of Presidential Decree No. 968


provides:

“Probation may be granted whether the sentence imposes a term


of imprisonment or a fine only”. x x x

4. That accused-applicant has none of the disqualifications


enumerated under Section 9 of Presidential Decree No. 968 (Probation
Law), as amended by R.A. 10707 and the penalty imposed upon him is well-
within the limits provided under the aforesaid law;

5. That accused applicant is ready and willing to abide by the
conditions that may be imposed by this Honorable Court upon him during
the period of his probation.

6. That the accused-applicant is ready and willing to undergo drug


dependency evaluation.

WHEREFORE, PREMISES CONSIDERED, it is most respectfully


prayed to this Honorable Court that the execution of the sentence in the
above-entitled case be suspended and accused-applicant be placed on
probation for such terms and conditions as the Honorable Court may deem it
best.

Praying for such other reliefs and remedies as may be just and
equitable under the premises.
