AFFIDAVIT IN SUPPORT OF IA

I, Rakesh Bose, aged about 34 years, S/o Sri. M.P. Gopinathan,


residing at Chethak House, Cherattukuzhi, Up Hill PO, Malappuram
District, Kerala – 676505, today at Bangalore, do hereby solemnly
affirm and state as follows:

1. I am the Petitioner in the above case and as such I am well


conversant with the facts of this case. I had suffered grievous
injuries in a road traffic accident, and I had to undergo amputation
of my left leg. I have been using the artificial limb, which was fixed
after the surgery leading to my amputation of my left limb. I had
filed the above case and this Hon’ble court had ordered a
compensation of Rs. 23 lakhs.

2. I state that I had filed an application under section 151 of CPC with
a prayer to transfer the compensation amount through E-Payment,
Accordingly the same was allowed by this Hon’ble Court and
directed the office to credit the amount of Rs. 10,05,493/- in my
name and the remaining amount of Rs.5,00,000/- to be kept in F.D
in any nationalized bank for 3 years as per the judgment passed by
this Hon’ble court.

3. I state that I have not collected the Bond dated 31-10-2017 For Rs.
5,00,000/-and 12-10-2021 for Rs. 5,00,000 to collect the same the
office has directed for the appearance of counsel on record for
identification purpose.

4. I state that, the Counsel on record in the above case in unable to


travel as he is residing at Kerala and due to his ill health. Hence I
have received No objection certificate for Vakalth to appoint
another counsel to represent on behalf of me.

5. I state that, I cannot travel often hence kindly I request this


Hon’ble Court to allow accompanying application advancing the
matter for today and to take the NOC Vakalth on record.

6. I State that, I have been rendered without a job due to my


accidental injuries and as such I have no source of income
presently. In addition I have spent large amounts of money in my
surgery and treatment and as such I am in dire need of money. I
am unable to purchase a new artificial limb, which is of advanced
technology and as such would at least allow me to live a slightly
better life, and to be able to move around.

WHEREFORE, I humbly pray that the Hon’ble Court may be


pleased to allow the accompanying application as prayed for in the
interests of justice and equity.

The contents of the above are true and correct to the best of my
knowledge, information and belief.
