STATEMENT OF FACTS OF COMPLAINT AGAINST BRUCE E. REINHART

IN THE MATTER OF THE SEARCH WARRANT OF FORMER PRESIDENT

DONALD J. TRUMP’S HOME

CASE 9:22 MJ-08332-BER

This Complaint is filed against Bruce E. Reinhart for unethical and prejudicial

conduct in the matter related to the above referenced case, wherein Judge Reinhart,

a magistrate of the federal United States Court for the Southern District of Florida,

signed a search warrant for the unprecedented search of the home and premises of

former United States President Donald J. Trump, wherein Judge Reinhart has a

conflict of interest and a pattern and history of hostility to President Trump, which

is supported by the following undisputed facts:

1. Judge Reinhart has publicly denigrated President Donald Trump in social

media posts, including this statement on his personal Facebook page in

2016, after President Trump had been elected president but before taking

office:

“Thank you, Robert Reich, for saying what many of us feel, ‘John

Lewis is the conscience of America. Donald Trump doesn’t have

 the moral stature to kiss John Lewis’s feet,’” Reinhart added. “Or,

as Joseph Welch said to Joseph McCarthy, ‘At long last, have you left

2. In June 2022, Judge Reinhart recused himself from a lawsuit involving

President Trump in his suit against Hillary Clinton, citing a “conflict of

interest.” The case involves litigation by President Trump against Hillary

Clinton related to the false accusations against the former President by

Clinton and prominent Democrats in the Russia collusion hoax; yet, six weeks

after that recusal, Judge Reinhart signed the warrant authorizing the FBI’s

search of President Trump's Mar-a-Lago estate. See Exhibit 3: Daily Mail

3. Judge Reinhart has a history of ethical issues, the most noteworthy being his

resignation from the US Attorney’s office in Miami on January 1, 2008, and

the very next day representing as counsel for employees of the late Jeffrey

Epstein, who was under investigation by that same prosecutor’s office at the

time of Reinhart’s employment and departure. An ethics complaint/lawsuit

was filed against Judge Reinhart for his unethical conduct. Former

colleagues at the US Attorney’s office stated their belief that Judge Reinhart

was privy to confidential information regarding the prosecution’s case

4. Judge Reinhart is a Democrat who has given financial contributions to

former Democratic President Barack Obama, and to former Florida

Governor Jeb Bush when he was a candidate running against Donald Trump

5. Clearly, Judge Reinhart is a partisan and has publicly expressed his partisan

views against former President Trump. His antipathy for the former

President is such that he should have recused when presented with the search

warrant for the highly problematic search of President Trump’s home in

Florida.

6. Judge Reinhart should be disciplined and removed as a federal magistrate

because of his failure to meet the standards of ethical conduct and character

necessary for the public to have confidence in the nonpartisan role of a judge

in a matter of this extreme public interest.

7. The entire episode of the unprecedented search of the former President’s

home, authorized by a political appointee of President Trump’s successor,

and approved by a federal magistrate who has been outspoken in his

opposition to and loathing of President Trump threatens the principle of

“equal justice under law” and the confidence of the American people in an

unbiased judiciary.

Judge Bruce Reinhart has come under scrutiny for his past political opinions and work as a
defense attorney

In his recusal, the magistrate wrote: 'The undersigned Magistrate Judge, to whom

the above-styled cause has been assigned, hereby recuses himself and refers the
case to the Clerk of Court for reassignment pursuant to 28 U.S.C. § 455.'

According to the specific code: 'Any justice, judge, or magistrate judge of the United
States shall disqualify himself in any in which his impartiality might reasonably be
questioned.'

The judge did not specify what disqualified him from overseeing the lawsuit. 

Earlier this week, Habba, along with fellow Trump lawyer Christina Bobb, accused
the FBI of planting evidence during Monday's raid.

While on her Truth Social page, Habba has made multiple attacks on Judge
Reinhart.  

Watters joked with Habba later in the interview asking if Trump himself had packed
any of the boxes that the FBI searched during the raid. 

Trump watched the raid live from Trump Tower in New York via the security camera
feeds in his Florida home, Bobb said during an interview with the right-wing media
network Real America's Voice earlier Friday. Bobb joked that the Trumps probably
had a better view than she did, and she was at Mar-a-Lago when the raid took place.

Habba also said in her Friday appearance: 'So explain to me, why you tell someone to
put an extra lock on, leave for almost two months, get a warrant, sit for a weekend,
have a cocktail and then show-up again, guns a blazing?' Not even informing the
local police, which is normal course. He wasn't even there. It makes no sense.'

Multiple news outlets have published articles detailing Judge Reinhart's past as a
defense attorney, which included a stint working for pedophile financier Jeffrey
Epstein, and making political donations to Barack Obama.

Trump is under investigation for obstruction of justice and violating the Espionage
Act, according to the newly unsealed search warrant showing the FBI retrieved 11
sets of classified documents from Mar-a-Lago.

The Florida federal magistrate judge who signed off on a search warrant authorizing the FBI

Sources tell The Post that Judge Bruce Reinhart approved the warrant that enabled federal

agents to converge on the palatial South Florida estate on Monday in what Trump called an
“unannounced raid on my home.”

Reinhart was elevated to magistrate judge in March 2018 after 10 years in private practice.
That November, the Miami Herald reported that he had represented several of Epstein’s
employees — including, by Reinhart’s own admission to the outlet, Epstein’s pilots; his
scheduler, Sarah Kellen; and Nadia Marcinkova, who Epstein once reportedly described as
his “Yugoslavian sex slave.”

Kellen and Marcinkova were among Epstein’s lieutenants who were granted immunity as
part of a controversial 2007 deal with federal prosecutors that allowed the pervert to plead
guilty to state charges rather than federal crimes. Epstein wound up serving just 13 months
in county jail and was granted work release.

The FBI raided Donald Trump’s Mar-a-Lago estate in Florida and broke into a safe in his palatial home, the former
president said Monday.

According to the Herald, which cited court documents, Reinhart resigned from the South

Florida US Attorney’s Office effective on New Year’s Day 2008 and went to work for
Epstein’s cohorts the following day.

Epstein, who was found dead in August 2019 of an apparent suicide in the Manhattan
Correctional Center while awaiting trial on federal sex-trafficking charges, had hired a stable
of high-powered lawyers for his defense in the late 2000s, including former independent
counsel Kenneth Starr.

Ten months after starting work for Epstein’s co-conspirators, according to Federal Election
Commission records, Reinhart gave $1,000 directly to the Obama campaign and another
$1,000 to its fundraising arm, the Obama Victory Fund. Though the records show the judge
made mostly small-dollar donations to his law firm’s political action committee in subsequent
years, Reinhart also donated $500 to Jeb Bush’s 2016 presidential campaign in November
2015.

Reinhart was later named in a civil lawsuit by two of Epstein’s victims that accused him of
violating Justice Department policies by switching sides in the middle of the Epstein
investigation, suggesting he had spilled inside information about the probe to build favor with
the notorious defendant, the Herald reported in 2018.

In a 2011 affidavit, Reinhart denied he had done anything improper and insisted that since he
was not involved in the federal investigation of Epstein, he was not privy to inside information
about the case.

However, in a 2013 court filing, Reinhart’s former colleagues contradicted him, saying that he
had “learned confidential, non-public information about the Epstein matter” while employed
by the US Attorney’s Office. Reinhart noted to the Herald in response that a complaint filed
against him by a lawyer for Epstein’s victims had been dismissed by the Justice Department.

As recently as January of 2015, Reinhart was asked to appear on right-wing channel

Newsmax to give analysis of the Epstein fallout — but declined to publicly note his own role
in the case.

Before entering private practice in 2008, Reinhart spent 12 years as a federal prosecutor.
According to an official biography circulated at the time he was hired as a magistrate judge,
Reinhart “managed a docket that covered the full spectrum of federal crimes, including
narcotics, violent crimes, public corruption, financial frauds, child pornography and
immigration.”

Reinhart is one of three federal magistrate judges in the West Palm Beach offices of the US
District Court for the Southern District Court of Florida, along with William Matthewman and
Ryon McCabe.

Two recent warrant applications were assigned to Reinhart and entered into the court system

on Monday, the Miami Herald reported, but those warrants and information about who they
targeted remain sealed. Records show another warrant was issued by Reinhart on Friday,
but its contents were also sealed.

Trump confirmed media reports of a raid at his Florida resort on Monday evening, saying
Mar-a-Lago was “under siege, raided, and occupied by a large group of FBI agents.”

The agents were reportedly searching the seaside property for boxes of classified
documents Trump allegedly brought to the ritzy resort after he left the White House in
January 2021, which would be a violation of federal record-keeping laws.

The National Archives and Records Administration said in February that it found classified
documents in 15 boxes at Mar-a-Lago and alerted the FBI.

The removal of classified documents to unauthorized locations is banned under federal law,
although Trump had wide powers when he was president to declassify documents.

The raid on Mar-a-Lago comes amid the House select committee’s continuing investigation
into Trump’s role in the Jan. 6, 2021, attack on the US Capitol as Congress met to certify the
2020 presidential election results.

A federal grand jury is also investigating the riot and Trump’s efforts to overturn the 2020
election.

As reported by the Miami Herald, Judge Reinhart began

representing Epstein’s employees on January 2nd, 2008,
just one day after departing the U.S. Attorney’s Of ce
where he served as an assistant U.S. attorney closely
involved on the convicted pedophile’s case.

Accused of leveraging “inside information about

Epstein’s investigation to curry favor with Epstein,” in
2011, he was named as a prosecutor who allegedly
violated the rights of an underage girl whom Epstein
solicited sex from in the Crime Victims’ Rights Act
lawsuit.

Reinhart appears to have exploited his role in the U.S.

Attorney’s Of ce to launch a private criminal defense
practice, according to the Miami Herald:

prosecutors, Bruce E. Reinhart, now a federal
magistrate, opened a limited liability company
in Florida that established what would become

Reinhart insisted that he never represented Epstein

himself — “only Epstein’s pilots; his scheduler, Sarah
Kellen; and Nadia Marcinkova, described by some
victims as Epstein’s sex slave.”

Reinhart donated twice to Obama’s campaign in 2008

totaling $2,000. Reinhart, who was appointed U.S.
magistrate in March 2018, also donated to the
campaign of Trump rival Jeb Bush in 2015.

have signed off on a warrant responsible for the raid on
Trump’s Palm Beach estate. A “source said FBI agents
obtained a search warrant from a federal magistrate
judge in West Palm Beach,” reports the Miami Herald.

Politico explained that of the three magistrate judges in

that of ce, two recent warrant applications, both of
which were assigned to Reinhart, were entered into the
system on Monday. The subject of the warrants,
however, remains sealed.


