The consequent numbering draw of plots held on 22-Jan-2021, Industrial
Plot No.1150, Sector - 101, Block-c , Measuring 500 Sq. Yard is hereby alloted
to you on the following terms and conditions :-

1 The allotment shall be subject to the provisions of the Punjab Regional and

Town Planning and Development Act,1995 read with Rules, Regulations &
Policies framed there under, from time to time.
2 You shall be required to pay the instalments of the price of this plot as per
the payment plan mentioned in condition no. 5 of the Letter of Intent
issued to you vide Memo No.38553 Dated.07-Sep-2017.
3 All payments shall be made through Demand Draft drawn in favour of
Estate Officer, Greater Mohali Area Development Authority (GMADA)
payable at SAS Nagar. Payment by cheque shall not be accepted. Details
of Plot Number, Area, Sector and Urban Estate should be indicated both in
forwarding letter and on the back of demand draft for avoiding any
misuse.
3 (A) No separate notice for payment of the amount of instalments shall be
sent and the allottee shall be bound to deposit the same on the due date.
4 In case of non-payment of instalments by the due date, the allottee shall
be liable to pay penal interest on the amount due at the rates determined
from time to time. However, before imposing er.
l ett penalty, Estate Officer shall
issue a notice and provide an opportunity r ated of being heard to the allottee

and pass an order in writing,stprovided

exceed the amount due.hiOn s is written request establishing genuine grounds,

any delay in payment of installments upto 24 months may be condoned by
the Estate Officer by charging penal interest @18% p.a for the period of
delay. Delays beyond 24 months shall not be condoned under any
circumstances and shall result in resumption of the plot and amount shall
be refunded after deducting 10% of the total amount of the consideration
money, interest and other dues payable in respect of the plot in
accordance with the provisions of Section 45 of Punjab Regional Town
Planning Act, 1995.
5 All corner or park / play area facing plots will be charged 10% extra price
of the plot and plots with both these features will be charged 15% extra
price of the plot (see page 6 of brochure).

6 The exact size of plot and its dimensions are subject to variation as per
actual measurement of plot at the time of delivery of possession. In case
the actual area of plot exceeds the area offered, the allottee would be
required to deposit the additional price for the excess area proportionately
as per square yard rate of plot. In case of reduction in area, the allotment
price will be proportionately reduced.

7 (A) In case of additional price on account of increase in area of plot as


per actual measurement being more than the allotted site as well as in
case of enhancement of compensation by the Court of Law or due to
increase in the cost of development works or otherwise due to delays
beyond the control of GMADA, will be charged extra as per scheme rate on
pro-rata basis. In case reduction in area, the excess amount shall be
refunded/adjusted as the case may be, on pro-rata basis.
7 (B) In case of additional price on account of any or all reasons mentioned
at Para 7(A), shall be payable by the present alottee/transferee within 30
days of issuance of the demand notice either er. in lumpsum OR in instalment

in 3 equal half yearly instalments with 12% per annum interest with first
instalment becoming due after 6 months from the date of issuance of
demand notice. In case present alottee/transferee fails to pay the amount
of additional price in the stipulated period, then penal interest @18% per
annum will be charged on the balance amount, without prejudice to the
rights of the Estate Officer, GMADA to initiate action for resumption of plot
as per provisions of the Punjab Regional and Town Planning and
Development Act, 1995 and as amended time to time.
8 After the payment of the entire consideration amount together with
interest due, the allottee shall execute a deed of conveyance in the
prescribed form and in such manner, as may be directed by the Estate

Officer, GMADA within 90 days of the payment of the entire consideration
amount plus interest together with any other due.
9 The allottee shall be required to take physical possession of the plot within
90 days of the issue of this allotment letter. In case allottee fails to take
the possession of the plot allotted within 90 days, the possession of plot
shall be deemed to have been delivered to the allottee on that day. In
case of non-feasibility of plot/site, the allottee shall inform the Estate
Officer in writing before the lapse of 90 days. Within 90 days of taking
over possession or deemed possession of plot, the allottee shall submit the
building plan for approval by the Competent Authority.
10 The possession of plot shall be offered on "as is where is" basis and the
allottee shall not be entitled to claim any rebate or refund on any ground
whatsoever. The Authority will not be responsible for levelling the uneven
site.
11 PUDA (Building) Rules, 2018 as amended from time to time, shall be
applicable. The allottee shall be allowed teto r. undertake construction of

12 The allottee shall be required to raise construction of building and also to
obtain completion certificate from the Competent Officer of GMADA within
a period of 5 years from date of possession or deemed possession, failing
which the Estate Officer may resume the plot, in accordance with the
provisions of section 45 of the Punjab Regional and Town Planning and
Development Act, 1995. In case allottee fails to do so, extension in
construction period upto maximum 3 years can be obtained by the allottee
and for this purpose the allottee will have to deposit 3% of the current
price of plot for 1st year, 4% of the current pirce of plot for 2nd year and
5% of the current price for 3rd year as extension fee. But allottee cannot
claim this extension in time limit as a matter of right.

13 In case of non-payment/delayed payment of extension fee, an additional
penalty interest shall be charged as per policy of GMADA.

14 The allottee will be provided separate domestic connections for fresh


water for drinking and potable uses and tertiary treated waste water for
flushing and gardening purpose. Therefore, the allottee will have to have
dual plumbing system along with separate storages for both types of
water in its building. It may be noted that occupation certificate shall be
issued only after it is certified by the Sub Divisional Engineer (Building),
GMADA that this provision has been made by the allottee. (This provision is
made in the scheme as per the orders of the State Level Environment
Impact Assessment Authority, Punjab and Ministry of Environment and
Forests, Government of India conveyed vide their letter no. 38523 dated
27-09-2011 and conditions imposed thereunder.)
15 No road cut is allowed without the prior permission of concerned Divisional
Engineer (Civil) GMADA, as road crossings have already been made for
various services for all the plots. tte

submersible pump set and lowering shall be allowed for this purpose.
17 GMADA has made arrangements for providing separate domestic
connections for rainwater disposal. Therefore, rainwater and floor washing
water should not be disposed off on road directly. The allottee will have to
make piping arrangements accordingly, failing which the allottee shall be
liable to pay expenses and damages to GMADA.
18 The plot/building shall be used only for the purpose for which it has been
allotted and strictly in accordance with the plans approved by the
Competent Authority. No obnoxious trade shall be carried out on this plot.
Change of land use shall not be allowed at any stage.

19 No fragmentation of the plot shall be permitted.
20 The allottee shall pay all general and local taxes, fees and cesses imposed
or assessed on the said site/building by the Municipal Authority or any
other authority competent under any law.

21 The ownership of plot shall continue to vest in the name of the Authority
until the entire consideration money together with interest and any other
dues, is paid in full to the Authority.
22 The Plot shall be transferrable (before full payment of plot) by way of sale,
gift or otherwise only with the prior permission of Estate Officer, GMADA,
SAS Nagar subject to the payment of such fee and charges as fixed by
GMADA + service tax thereon from time to time and clearance of all
outstanding dues.
23 The Authority or its officials may enter in any part of the plot/building at
reasonable time and in reasonable manner after giving 24 hours notice in
writing for the purpose of ascertaining that ttthe er. allottee has duly performed

24 In case allottee commits breach of any of the terms and conditions of this
allotment letter or the provisions of the Punjab Regional & Town Planning
& Development Act, 1995 and the Rules framed there under and as
amended from time to time or any of the conditions of transfer, the Estate
Officer, GMADA may resume the land or building or both, as the case may
be as per the provisions of section 45 of the Punjab Regional and Town
Planning and Development Act, 1995 as amended from time to time.
25 The Authority shall have full rights, powers at all times to do through its
officers or servants all acts and things which may be necessary and
expedient for the purpose of enforcing compliance with all or any of the
terms, conditions and reservation imposed and to recover from the allottee

as first charge upon the said site, the cost of doing all or any such act and
things and all cost, incurred in connection therewith, or any way relating
therewith.
26 Any change in address must be notified in writing to the Estate Officer,
GMADA, SAS Nagar (Mohali).
27 In case terms and conditions of allotment, as detailed above, are
acceptable, you are required to send your acceptance by registered post
within 30 days of issue of allotment letter (excluding date of issue). If the
request is not received within stipulated period, it shall be deemed to have
been accepted. In case of refusal to accept the allotment offer then such
refusal in writing through a registered post should be received within 30
days from the date of issue of allotment letter. In case of refusal to accept
the allotment, 10% of total amount + including interest & penalty and any
other dues shall be forfeited as per law.
28 Before occupying the building, the allottee shall be required to obtain
completion certificate/occupation certificater. from the Estate Officer,

which may arise in any manner touching or concerning this allotment shall
be referred to the Independent Arbitrator, directly or not directly related to
this office, shall be appointed by the Chief Administrator, GMADA.
Arbitration shall be governed by the Arbitration and Conciliation
(Amendment) Act, 2015, GMADA and the allottee shall be liable to share
the fees of the Arbitrator in equal proportion.”
