3 The time is 10 o'clock a.m. eastern. We are convened in the Longworth House Office
4 Building for the deposition of Mr. Jewll Powdrell to be conducted by the House Select
5 Committee to Investigate the January 6th Attack on the United States Capitol.
10 For the record, it is 10:01 a.m., and Mr. Powdrell is not present. The person
11 transcribing this proceeding is the House Stenographer and notary public authorized to
12 administer oaths.
15 deposition on February 23rd, 2022, at 10 o'clock a.m. This subpoena pertains to the
16 select committee's investigation into the facts, circumstances, and causes of the
17 January 6th attack, and issues relating to the peaceful transfer of power in order to
18 identify and evaluate lessons learned and to recommend to the House and its relevant
21 investigative counsel for the select committee, and left a voicemail message. In the
22 message, Mr. Powdrell indicated that he did not possess any documents relating to either
23 the electoral college vote on December 14th, 2020, or the attack on the United States
24 Capitol on January 6th, 2021. Mr. Powdrell further indicated that he would not appear
2 the call, Mr. Powdrell reiterated his earlier claims and stated that he had no information
3 to provide to the select committee. When asked, Mr. Powdrell confirmed that he acted
4 as an alternate elector in the State of New Mexico for the 2020 Presidential election and
5 that he signed and submitted certificates purporting to cast electoral college votes for
6 Donald J. Trump for President and Michael Pence for Vice President.
7 During the call, Mr. Powdrell indicated that he cannot travel due to family
9 that the select committee is willing to speak with him remotely via video teleconference
10 and at a time of his choosing. Mr. Powdrell indicated that he had given us his answers
13 Powdrell did not answer. - t h e n sent Mr. Powdrell a text message that read,
14 quote: Mr. Powdrell, I'm reaching out again from the select committee to Investigate
15 the January 6th attack on the U.S. Capitol. The deposition tomorrow will occur at
16 10 a.m. eastern. As I mentioned on the phone, we are happy to proceed via video
17 conference, if you so choose. Please contact me with any updates you may have.
18 As of right now, at 10:04 a.m., Mr. Powdrell has not responded to either o f -
19 - a t t e m p t s to contact him.
21 to Mr. Powdrell that he has a legal requirement to comply with the select committee's
22 subpoena, and, further, that failing to do so could subject him to legal consequences.

1 I will mark as exhibit 1 and enter into the record the select committee subpoena
2 to Mr. Powdrell, which was accompanied by a letter from the chairman, document
3 schedule with accompanying production instructions, and a copy of the deposition rules.
6 With that, I will note for the record that it is 10:05 a.m., and Mr.
7 Powdrell still has not appeared or communicated to the select committee that he will
8 appear today as required by the subpoena. Accordingly, the record is now closed as of
9 10:06 a.m.
