STATEMENT IN TERMS OF SECTION 112(2) OF THE CRIMINAL PROCEDURE ACT


51 OF 1977

I, the undersigned,
HELMUT KEIZER

Plead guilty to the charges against me and declare, without being influenced thereto, that:

1.

I am at present a 47 year old male and the accused in this matter.

2.

I was the driver of a motor vehicle with registration letters and number CEY 45238, which
motor vehicle I was driving on Beach Road, a public road within the area of jurisdiction of
the above Honourable Court.
3.

I was arrested on the 11th of December 2017, after I was stopped in a routine roadblock
and found to have an excess alcohol level in my breath.

4.

On the 10th of December 2017, I attended a family reunion braai in Uitzicht, Cape Town
where I consumed alcohol.

5.

I, realising that I was not in a fit state to drive, slept at the host’s house until the next
morning.

6.

When I woke up, at around 9am, I felt perfectly fine and suggested that we all go visit the
beach in Strand as it was a lovely day.

It was in Strand, at corner of Beach Road and Culenborg Roads, and at approximately
11:50am that I was pulled over in a routine roadblock and randomly breathalysed.

I was arrested for having excess alcohol in my breath.

I was then taken first to Strand SAPS in order to open a case docket and then to Athlone
shadow centre where the Draeger alcohol test was employed and confirmed the excess
alcohol level, of 0,87mg/1000ml, in my breath. I admit that this test was performed within
two hours of my arrest and that the test was performed and analysed correctly.

I admit that at the time of my arrest my breath-alcohol level was 0,87mg/1000ml and that
this level exceeds the prescribed maximum breath alcohol level of 0,24mg/1000ml.

I admit that I was at the time of driving aware of the fact that it is a criminal offence to
drive a motor vehicle whilst the alcohol contents of one's breath exceeds
0,24mg/1000ml, and I accordingly admit that my actions were wrongful and unlawful.
