MOST RESPECTFULLY SHOWETH:
1. That the aforementioned case was pending for adjudication before this
Hon'ble Court; however, this Hon'ble Court after the due consideration,
deemed it fit to dispose of the matter as "Uncontested/Plaint Returned" on
04.05.2023.
2. That after disposing off the aforementioned matter, this Hon'ble Court
was pleased to return the original plaint, along with all accompanying
documents and 04.05.2023, in order to file the aforementioned case
before the competent court of jurisdiction in accordance with law.
3. That the applicant/plaintiff bank seeks the requisite certificate from this
Hon'ble Court for the refund of the court fees that was deposited for the
aforementioned case.
4. That the Hon'ble Supreme Court, in a case titled "DR (Col.) Subhash
Chandra Talwar Vs. T. Choithram and Sons & Ors.," addressed a
similar matter and rendered a judgment stating that if a plaint is returned,
the plaintiff becomes entitled to a refund of the court fee. The copy of the
aforementioned judgement is attached herewith.
PRAYER
In view of the facts and circumstances mentioned hereinabove, it is therefore,
most respectfully prayed that this Hon'ble court may graciously be pleased to
issue a certificate for refund of the court fee to the plaintiff/applicant, in the
interest of justice.
