4.The second party shall be appointed under probation for ‫ ﻭﺇﺫﺍ‬، ‫ ﻣﻦ ﺗﺎﺭﻳﺦ ﺇﺳﺘﻼﻣﻪ ﺍﻟﻌﻤﻞ‬،‫ ﻳﻮﻡ‬90‫ﻳﻌﻴﻦ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺗﺤﺖ ﺍﻹﺧﺘﺒﺎﺭ ﻟﻤﺪﺓ‬.4
90 Days from the date of commencing work. If one of the ‫ﺭﻏﺐ ﺃﺣﺪ ﺍﻟﻄﺮﻓﻴﻦ ﺇﻧﻬﺎﺀ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﺟﺐ ﻋﻠﻴﻪ ﺇﺧﻄﺎﺭ ﺍﻟﻄﺮﻑ ﺍﻵﺧﺮ ﻛﺘﺎﺑﺔ ﻗﺒﻞ ﺍﻹﻧﻬﺎﺀ‬
two parties’ desires to terminate the contract, he shall notify ‫( ﺳﺒﻌﺔ ﺃﻳﺎﻡ ﻋﻠﻰ ﺍﻷﻗﻞ ﺧﻼﻝ ﻓﺘﺮﺓ ﺍﻻﺧﺘﺒﺎﺭ )ﻳﺠﺐ ﺃﻻ ﺗﺰﻳﺪ ﻣﺪﺓ ﺍﻹﺧﺘﺒﺎﺭ ﻋﻠﻰ‬7) ‫ﺏ‬
the other party in writing, at least 7 days before the contract ‫( ﺷﻬﺮﻳﻦ ﻟﻤﻦ‬2) ‫( ﺛﻼﺛﺔ ﺃﺷﻬﺮ ﻟﻤﻦ ﻳﺘﻘﺎﺿﻰ ﺍﺟﺮﻩ ﺷﻬﺮﻳﺎ ﻭﻟﻤﺪﺓ ﻻ ﺗﺰﻳﺪ ﻋﻠﻰ‬3)

5.The first party shall transfer the wage of the worker ‫ﻋﻠﻰ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺗﺤﻮﻳﻞ ﺃﺟﺮ ﺍﻟﻌﺎﻣﻞ )ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ( ﺍﻟﻰ ﺣﺴﺎﺑﻪ ﺑﺄﺣﺪ ﺍﻟﻤﺼﺎﺭﻑ‬.5
(second party) to his Bank account at one of the endorsed ‫ﺍﻟﻤﺤﻠﻴﺔ ﺃﻭﺍﻟﻤﺆﺳﺴﺎﺕ ﺍﻟﻤﺎﻟﻴﺔ ﺍﻟﻤﺤﻠﻴﺔ ﺍﻟﻤﺮﺧﺼﺔ ﻣﻦ ﺍﻟﺒﻨﻚ ﺍﻟﻤﺮﻛﺰﻱ ﺍﻟﻌﻤﺎﻧﻲ ﻓﻲ ﺍﻟﺘﺎﺭﻳﺦ‬
local banks or financial institution licensed by the Central .‫( ﺛﻼﺛﺔ ﺃﻳﺎﻡ ﻣﻦ ﺗﺎﺭﻳﺦ ﺍﻹﺳﺘﺤﻘﺎﻕ‬3) ‫ﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻪ ﺧﻼﻝ ﻣﺪﻩ ﻻ ﺗﺘﺠﺎﻭﺯ‬

note more (3) days from the entitlement date.

6.The first party shall be banned from the following: :‫ﻳﺤﻈﺮ ﻋﻠﻰ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺍﻟﻘﻴﺎﻡ ﺑﻤﺎ ﻳﻠﻲ‬.6
a.Employing the second party in construction sites and ‫ﺗﺸﻐﻴﻞ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﻓﻲ ﻣﻮﺍﻗﻊ ﺍﻹﻧﺸﺎﺀﺍﺕ ﻭﺍﻷﻣﺎﻛﻦ ﺍﻟﻤﻜﺸﻮﻓﺔ ﺫﺍﺕ ﺍﻟﺤﺮﺍﺭﺓ ﺍﻟﻌﺎﻟﻴﺔ‬.‫ﺃ‬
open areas with high temperatures at noon in accordance ‫ﻓﻲ ﺃﻭﻗﺎﺕ ﺍﻟﻈﻬﻴﺮﺓ ﻭﻓﻘﺎً ﻷﺣﻜﺎﻡ ﺍﻟﻼﺋﺤﺔ ﺍﻟﺘﻨﻈﻴﻤﻴﺔ ﻟﺘﺪﺍﺑﻴﺮ ﺍﻟﺴﻼﻣﺔ ﻭﺍﻟﺼﺤﺔ ﺍﻟﻤﻬﻨﻴﺔ‬
with the provisions of the regulations for occupational safety
and health measures.

b.Violating the provisions of this contract, or tasking the ‫ﺍﻟﺨﺮﻭﺝ ﻋﻠﻰ ﻧﺼﻮﺹ ﺍﻟﻌﻘﺪ ﺃﻭ ﺗﻜﻠﻴﻒ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﻐﻴﺮ ﺍﻟﻌﻤﻞ ﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻪ ﻓﻲ‬.‫ﺏ‬
second party with a work which is not agreed upon in the ‫ ﻭﻣﻊ ﺫﻟﻚ ﻳﺠﻮﺯ ﻟﻪ ﺃﻥ ﻳﻜﻠﻒ‬،‫ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺇﻻ ﺍﺫﺍ ﺩﻋﺖ ﺍﻟﻀﺮﻭﺭﺓ ﻟﺬﻟﻚ ﻭﺑﺼﻔﺔ ﻣﺆﻗﺘﻪ‬
contract, unless necessity arises and for a transitional ‫ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﻌﻤﻞ ﻏﻴﺮﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻪ ﺇﺫﺍ ﻛﺎﻥ ﺍﻟﻌﻤﻞ ﻻ ﻳﺨﺘﻠﻒ ﻋﻦ ﺍﻟﻌﻤﻞ ﺍﻷﺻﻠﻲ‬
period. However, the employer may assign the worker or ً‫ﺍﺧﺘﻼﻓﺎً ﺟﻮﻫﺮﻳﺎ‬
the second party only if there is no fundamental difference
between the new tasks and the original work he is
contracted for.

c.To allow any non-Omani worker, who has been granted a ‫ﺃﻥ ﻳﺴﻤﺢ ﻷﻱ ﻋﺎﻣﻞ ﻣﻦ ﺍﻟﻌﻤﺎﻝ ﻏﻴﺮ ﺍﻟﻌﻤﺎﻧﻴﻴﻦ ﻣﻤﻦ ﺭﺧﺺ ﻟﻪ ﻓﻲ ﺗﺸﻐﻴﻠﻬﻢ ﻭﻣﻨﺤﺖ‬.‫ﺝ‬
work permit and a work license, to work for someone else ‫ﻟﻪ ﺭﺧﺼﺔ ﻣﺰﺍﻭﻟﺔ ﻋﻤﻞ ﺃﻥ ﻳﻌﻤﻞ ﻟﺪﻯ ﻏﻴﺮﻩ ﺇﻻ ﺑﻌﺪ ﺇﺑﻼﻍ ﺍﻟﻮﺯﺍﺭﺓ ﺇﻟﻜﺘﺮﻭﻧﻴﺎ‬
only after electronically notifying the Ministry and obtaining ‫ﻭﺗﺮﺧﻴﺼﻬﺎ ﻟﻪ ﻓﻲ ﺫﻟﻚ‬
its approval.

d.To employ any non-Omani worker who is licensed to work ‫ﺃﻥ ﻳﺸﻐﻞ ﺃﻱ ﻋﺎﻣﻞ ﻏﻴﺮ ﻋﻤﺎﻧﻲ ﻣﺮﺧﺺ ﻟﻪ ﺑﺎﻟﻌﻤﻞ ﻟﺪﻯ ﻏﻴﺮﻩ ﺇﻻ ﺑﻌﺪ ﺗﺰﻭﻳﺪ ﺍﻟﻮﺯﺍﺭﺓ‬.‫ﺩ‬
for others, except after providing the Ministry electronically ‫ﺇﻟﻜﺘﺮﻭﻧﻴﺎ ﺑﺒﻴﺎﻧﺎﺕ ﺍﻟﻌﺎﻣﻞ ﻭﻋﻨﻮﺍﻥ ﻋﻤﻠﻪ ﻭﻓﻖ ﺍﻻﺳﺘﻤﺎﺭﺓ ﺍﻟﻤﺤﺪﺩﺓ‬
with the worker's data and his work address according to
the specified form.

e.To employ any non-Omani worker in any profession ‫ﺃﻥ ﻳﺸﻐﻞ ﺃﻱ ﻋﺎﻣﻞ ﻏﻴﺮ ﻋﻤﺎﻧﻲ ﻓﻲ ﺃﻱ ﻣﻬﻨﺔ ﺗﻘﺮﺭ ﻗﺼﺮ ﺍﻟﺘﺸﻐﻴﻞ ﻓﻴﻬﺎ ﻋﻠﻰ‬.‫ﻱ‬
where employment is restricted to Omani nationals. ‫ﺍﻟﻌﻤﺎﻧﻴﻴﻦ‬

7.As it is prohibited for non-Omani individuals to take up ‫ﻛﻤﺎ ﻳﺤﻈﺮ ﻋﻠﻰ ﻏﻴﺮ ﺍﻟﻌﻤﺎﻧﻲ ﺍﻹﻟﺘﺤﺎﻕ ﺑﺄﻱ ﻋﻤﻞ ﻓﻲ ﺳﻠﻄﻨﺔ ﻋﻤﺎﻥ ﻗﺒﻞ ﺍﻟﺤﺼﻮﻝ‬.7

Employment Contract for non-Omanis

a.Successful completion of professional standards tests for ‫ﺃﻥ ﻳﺠﺘﺎﺯ ﺍﺧﺘﺒﺎﺭﺍﺕ ﺍﻟﻤﻌﺎﻳﻴﺮ ﺍﻟﻤﻬﻨﻴﺔ ﻟﻤﻤﺎﺭﺳﺔ ﺍﻟﻤﻬﻦ ﺍﻟﺘﻲ ﺗﺤﺪﺩﻫﺎ ﺍﻟﺠﻬﺔ ﺍﻟﻤﺨﺘﺼﺔ‬.‫ﺃ‬
the practice of professions specified by the relevant ‫ﻭﺗﺼﺪﺭ ﺑﻘﺮﺍﺭ ﻣﻦ ﺍﻟﻮﺯﻳﺮ ﻗﺎﺋﻤﺔ ﺑﺎﻟﻤﻬﻦ ﺍﻟﺘﻲ ﺗﺘﻄﻠﺐ ﺷﻬﺎﺩﺓ ﻣﺰﺍﻭﻟﺔ ﺍﻟﻤﻬﻨﺔ‬
authority, accompanied by a ministerial decision listing
professions that necessitate a professional certificate.

b.The worker must have entered the Sultanate of Oman ‫ ﻭﻣﺴﺘﻮﻓﻴﺎ ﺍﻟﺸﺮﻭﻁ‬،‫ﺃﻥ ﻳﻜﻮﻥ ﺍﻟﻌﺎﻣﻞ ﻗﺪ ﺩﺧﻞ ﺳﻠﻄﻨﺔ ﻋﻤﺎﻥ ﺑﻄﺮﻳﻘﺔ ﻣﺸﺮﻭﻋﺔ‬.‫ﺏ‬
legally, meeting the conditions specified in the Foreign ‫ﺍﻟﻤﻨﺼﻮﺹ ﻋﻠﻴﻬﺎ ﻓﻲ ﻗﺎﻧﻮﻥ ﺇﻗﺎﻣﺔ ﺍﻷﺟﺎﻧﺐ ﻭﺍﻟﻠﻮﺍﺋﺢ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﺼﺎﺩﺭﺓ ﺗﻨﻔﻴﺬﺍ ﻟﻪ‬
Residence Law, its regulations and implementing decisions.

c.The worker must be in good health and free from ‫ﺃﻥ ﻳﻜﻮﻥ ﺍﻟﻌﺎﻣﻞ ﻻﺋﻘﺎ ﻣﻦ ﺍﻟﻨﺎﺣﻴﺔ ﺍﻟﺼﺤﻴﺔ ﻭﺧﺎﻟﻴﺎ ﻣﻦ ﺍﻷﻣﺮﺍﺽ ﺍﻟﺘﻲ ﺗﺤﺪﺩﻫﺎ ﻭﺯﺍﺭﺓ‬.‫ﺝ‬
diseases specified by the Ministry of Health. ‫ﺍﻟﺼﺤﺔ‬

d.That the worker has a contract with an employer who has ‫ﺃﻥ ﻳﻜﻮﻥ ﺍﻟﻌﺎﻣﻞ ﻣﺘﻌﺎﻗﺪﺍ ﻣﻊ ﺻﺎﺣﺐ ﻋﻤﻞ ﺣﺎﺋﺰ ﻋﻠﻰ ﺍﻟﺘﺮﺍﺧﻴﺺ ﺍﻟﻼﺯﻣﺔ ﻣﻦ ﺍﻟﺠﻬﺎﺕ‬.‫ﺩ‬
Obtained the necessary licenses from the competent ‫ﺍﻟﺤﻜﻮﻣﻴﺔ ﺍﻟﻤﺨﺘﺼﺔ‬
government Agencies.

e.Pay the prescribed fees. ‫ ﺳﺪﺍﺩ ﺍﻟﺮﺳﻮﻡ ﺍﻟﻤﻘﺮﺭﺓ‬.‫ﻱ‬

8.The employer undertakes to repatriate the non- Omani ‫ﻳﻠﺘﺰﻡ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺑﺈﻋﺎﺩﺓ ﺍﻟﻌﺎﻣﻞ ﻏﻴﺮ ﺍﻟﻌﻤﺎﻧﻲ ﺇﻟﻰ ﺑﻠﺪﻩ ﺃﻭ ﺇﻟﻰ ﺃﻱ ﺑﻠﺪ ﺁﺧﺮ ﻳﺘﻢ‬.8
worker to his home country or any other agreed-upon ‫ ﻭﻋﻠﻰ‬،‫( ﺳﺘﻮﻥ ﻳﻮﻣﺎ‬60) ‫ﺍﻻﺗﻔﺎﻕ ﻋﻠﻴﻪ ﺑﻌﺪ ﺍﻧﺘﻬﺎﺀ ﻋﻘﺪ ﺍﻟﻌﻤﻞ ﺧﻼﻝ ﻣﺪﺓ ﺃﻗﺼﺎﻫﺎ‬
destination upon the expiration of the employment contract, ‫ ﺑﺮﺍﺀﺓ ﺫﻣﺔ ﻣﻦ ﺃﻱ ﺍﻟﺘﺰﺍﻣﺎﺕ ﺗﺠﺎﻫﻪ ﻋﻨﺪ‬،‫ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻣﻨﺢ ﺍﻟﻌﺎﻣﻞ ﺑﻨﺎﺀ ﻋﻠﻰ ﻃﻠﺒﻪ‬
with a maximum period of 60 days. The employer is also ‫ ﻭﻓﻲ ﺣﺎﻝ ﺍﻣﺘﻨﺎﻉ ﺍﻟﻌﺎﻣﻞ ﻋﻦ ﺍﻟﺴﻔﺮ ﺗﻘﻮﻡ‬.‫ ﺃﻭ ﻣﻐﺎﺩﺭﺗﻪ ﺳﻠﻄﻨﺔ ﻋﻤﺎﻥ‬،‫ﺍﻧﺘﻬﺎﺀ ﻋﻘﺪ ﺍﻟﻌﻤﻞ‬
obligated to provide the worker, upon request, with a ‫ﺍﻟﺠﻬﺔ ﺍﻟﻤﺨﺘﺼﺔ ﺑﺈﻋﺎﺩﺓ ﺍﻟﻌﺎﻣﻞ ﻋﻠﻰ ﻧﻔﻘﺔ ﺍﻟﻮﺯﺍﺭﺓ ﻭﺍﻟﺮﺟﻮﻉ ﻋﻠﻰ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ‬
clearance of any obligations towards him upon the .‫ﺑﺎﻟﺘﻜﺎﻟﻴﻒ ﺍﻟﺘﻲ ﺗﻜﺒﺪﺗﻬﺎ ﺍﻟﻮﺯﺍﺭﺓ ﻓﻲ ﺳﺒﻴﻞ ﺫﻟﻚ‬
termination or departure from the Sultanate of Oman.
‫ﻭﻳﺤﻖ ﻟﻠﻌﺎﻣﻞ ﺍﻟﺒﻘﺎﺀ ﻓﻲ ﺳﻠﻄﻨﺔ ﻋﻤﺎﻥ ﻓﻲ ﺣﺎﻝ ﻗﻴﺎﻣﻪ ﺑﺮﻓﻊ ﺩﻋﻮﻯ ﻗﻀﺎﺋﻴﺔ ﻟﻠﻤﻄﺎﻟﺒﺔ‬
In the event of the worker's refusal to travel, the competent ‫ﺑﻤﺴﺘﺤﻘﺎﺗﻪ ﺇﻟﻰ ﺃﻥ ﻳﺘﻢ ﺍﻟﺒﺖ ﻓﻲ ﺩﻋﻮﺍﻩ ﺩﻭﻥ ﺃﻥ ﻳﺘﺤﻤﻞ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺃﻱ ﺗﺒﻌﺎﺕ ﻣﺎﻟﻴﺔ‬
authority will repatriate the worker at the expense of the .‫ﺗﺠﺎﻩ ﺫﻟﻚ‬
Ministry, and the costs incurred will be charged back to the
employer.

9.In the event that both parties wish to adhere to additional ‫ ﺗﺤﺮﺭ ﻓﻲ ﻣﻠﺤﻖ ﺃﺧﺮ‬، ‫ﻓﻲ ﺣﺎﻟﺔ ﻭﺟﻮﺩ ﺷﺮﻭﻁ ﺃﺧﺮﻯ ﻳﺮﻏﺐ ﺍﻟﻄﺮﻓﻴﻦ ﺍﻹﻟﺘﺰﺍﻡ ﺑﻬﺎ‬.9
terms, these shall be incorporated into an annex to his ‫ ﻣﻊ ﻣﺮﺍﻋﺎﺓ ﺃﻥ ﺗﻜﻮﻥ ﻣﻄﺎﺑﻘﺔ‬، ‫ﺧﺎﺭﺝ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺩﻭﻥ ﺍﻟﺘﺼﺪﻳﻖ ﻋﻠﻴﻬﺎ ﻣﻦ ﻗﺒﻞ ﺍﻟﻮﺯﺍﺭﺓ‬
contract without requiring endorsement by the ministry, ‫ﻭﻳﺠﺐ ﺃﻥ ﻳﻜﻮﻥ ﺍﻟﻌﻘﺪ ﺍﻭ ﺍﻟﻤﻠﺤﻖ ﺛﺎﺑﺘﺎً ﺑﺎﻟﻜﺘﺎﺑﺔ ﻭﻣﺤﺮﺭﺍً ﺑﺎﻟﻠﻐﺔ‬.‫ﻷﺣﻜﺎﻡ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ‬
provided that they align with the provisions of the labour ‫ ﻭﺇﺫﺍ ﻛﺎﻥ ﺍﻟﻌﻘﺪ ﻣﺤﺮﺭﺍً ﺑﻐﻴﺮ ﺍﻟﻌﺮﺑﻴﺔ ﺗﺮﻓﻖ ﺑﻪ‬، ‫ﺍﻟﻌﺮﺑﻴﺔ ﻣﻦ ﻧﺴﺨﺘﻴﻦ ﻟﻜﻞ ﻃﺮﻑ ﻧﺴﺨﺔ‬
law. The agreement shall be documented in Arabic, with ‫ ﻭﻋﻨﺪ ﺍﻹﺧﺘﻼﻑ ﻓﻲ ﺍﻟﺘﻔﺴﻴﺮ‬، ‫ﻋﻠﻰ ﺍﻷﻗﻞ ﻧﺴﺨﺔ ﻣﺤﺮﺭﺓ ﺑﺎﻟﻌﺮﺑﻴﺔ ﻳﻌﺘﻤﺪﻫﺎ ﻃﺮﻓﺎ ﺍﻟﻌﻘﺪ‬
two copies, one for each party. If the contract is drafted in a .‫ﻳﻌﺘﺪ ﺑﺎﻟﻨﺴﺨﺔ ﺍﻟﻌﺮﺑﻴﺔ‬
language other than Arabic, an Arabic version must be
appended and endorsed by both parties. In the event of any
discrepancies in interpretation, the Arabic version shall
prevail.

10.The second party is entitled to an annual leave with a ‫ ﻭﻳﺘﻤﺘﻊ ﺍﻟﻌﺎﻣﻞ‬،‫ ﻳﻮﻡ‬30 ‫ﻳﺴﺘﺤﻖ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺇﺟﺎﺯﺓ ﺳﻨﻮﻳﺔ ﺑﺄﺟﺮ ﺷﺎﻣﻞ ﻟﻤﺪﺓ‬.10
comprehensive wage for 30 days according to the ‫ ﻭﻻ ﻳﺠﻮﺯ ﻟﻠﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺍﻟﻘﻴﺎﻡ ﺑﺎﻹﺟﺎﺯﺓ‬، ‫ﺑﺎﻹﺟﺎﺯﺓ ﺣﺴﺐ ﻣﻘﺘﻀﻴﺎﺕ ﻣﺼﻠﺤﺔ ﺍﻟﻌﻤﻞ‬
necessity of work after completing at least (6) Month from ‫( ﺳﺘﺔ ﺃﺷﻬﺮ ﻋﻠﻰ ﺍﻷﻗﻞ ﻣﻦ ﺗﺎﺭﻳﺦ ﺇﻟﺘﺤﺎﻗﻪ ﺑﺎﻟﻌﻤﻞ ﻟﺪﻯ‬6) ‫ﺍﻹﻋﺘﻴﺎﺩﻳﺔ ﻗﺒﻞ ﺇﻧﻘﻀﺎﺀ‬
the date of assuming work. The duration of the leave shall .ً‫ ﻳﻮﻡ ﺳﻨﻮﻳﺎ‬30 ‫ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻋﻠﻰ ﺃﻥ ﻻ ﺗﻘﻞ ﻣﺪﺓ ﺍﻹﺟﺎﺯﺓ ﻋﻦ‬

11.The first party shall grant the second party weekly rest of ‫ﻋﻠﻰ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺃﻥ ﻳﻤﻨﺢ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺭﺍﺣﺔ ﺃﺳﺒﻮﻋﻴﺔ ﻻ ﺗﻘﻞ ﻋﻦ ﻳﻮﻣﻴﻦ‬.11

shall not be derived of his right to weekly rest days due to ‫ﻭﻳﺠﻮﺯ ﻓﻲ ﺍﻷﻋﻤﺎﻝ ﻭﺍﻟﻤﻨﺎﻃﻖ ﺍﻟﺘﻲ ﻳﺤﺪﺩﻫﺎ ﺍﻟﻮﺯﻳﺮ ﺟﻤﻊ‬.‫ﺍﻟﻌﻤﻞ ﺑﻌﺬﺭ ﺃﻭ ﺑﺪﻭﻥ ﻋﺬﺭ‬
his absence from work with or without excuse. In the works .[ 77‫ ] ﺍﻟﻤﺎﺩﺓ‬.‫ﺍﻟﺮﺍﺣﺔ ﺍﻷﺳﺒﻮﻋﻴﺔ‬
and areas specified by the minister. The weekly rest may
be combined. [ Article 77 ].

12.The employer may grant the worker, based on his ‫ﻳﺠﻮﺯ ﻟﺼﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻣﻨﺢ ﺍﻟﻌﺎﻣﻞ ﺑﻨﺎﺀ ﻋﻠﻰ ﻃﻠﺒﻪ ﺇﺟﺎﺯﺓ ﺧﺎﺻﺔ ﺑﺪﻭﻥ ﺃﺟﺮ ﻋﻠﻰ ﺃﻥ‬.12
request, special leave without pay, and in this case, the ‫ﻳﺘﺤﻤﻞ ﺍﻟﻌﺎﻣﻞ ﻓﻲ ﻫﺬﻩ ﺍﻟﺤﺎﻟﺔ ﻛﺎﻓﺔ ﺍﻻﺷﺘﺮﺍﻛﺎﺕ ﻓﻲ ﺻﻨﺪﻭﻕ ﺍﻟﺤﻤﺎﻳﺔ ﺍﻻﺟﺘﻤﺎﻋﻴﺔ‬
worker must bear all contributions to the Social Protection ‫ ﻭﺗﻌﺘﺒﺮ ﻫﺬﻩ‬،‫ﻣﺘﻀﻤﻨﻪ ﻧﺴﺒﺘﻪ ﻭﻧﺴﺒﺔ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻭﺍﻟﺤﻜﻮﻣﺔ ﺧﻼﻝ ﻓﺘﺮﺓ ﺍﻹﺟﺎﺯﺓ‬
Fund covering his percentage,the percentage of the ‫ﺍﻹﺟﺎﺯﺓ ﺿﻤﻦ ﻣﺪﺓ ﺧﺪﻣﺔ ﺍﻟﻌﺎﻣﻞ ﻭﻻ ﻳﻌﺘﺪ ﺑﺘﻠﻚ ﺍﻟﻤﺪﺓ ﻓﻲ ﺍﺣﺴﺎﺏ ﻣﻜﺎﻓﺄﺓ ﻧﻬﺎﻳﺔ ﺍﻟﺨﺪﻣﺔ‬
employer, and the percentage of the government during the .‫[ ﻣﻦ ﻫﺬﺍ ﺍﻟﻘﺎﻧﻮﻥ‬61‫ﺍﻟﻤﻨﺼﻮﺹ ﻋﻠﻴﻬﺎ ﻓﻲ ]ﺍﻟﻤﺎﺩﺓ‬
leave period. This leave is considered within the period of
service of the worker and this period is not counted in the
calculation of the end-of service gratuity stipulated in [article
61] of this law.

13.The leave may be divided in accordance with the ‫ ﻭﺫﻟﻚ ﻓﻴﻤﺎ ﻋﺪﺍ ﺇﺟﺎﺯﺍﺕ‬،‫ﻳﺠﻮﺯ ﺗﺠﺰﺋﺔ ﺍﻹﺟﺎﺯﺓ ﻭﻓﻘﺎ ﻟﻤﻘﺘﻀﻴﺎﺕ ﻣﺼﻠﺤﺔ ﺍﻟﻌﻤﻞ‬.13
requirements of the interest of work, with the exception of ‫ ﻭﻟﺼﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺗﺄﺟﻴﻞ ﺍﻹﺟﺎﺯﺓ ﺍﻟﺴﻨﻮﻳﺔ ﻟﻠﻌﺎﻣﻞ ﺇﺫﺍ ﺍﻗﺘﻀﺖ ﻣﺼﻠﺤﺔ‬.‫ﺍﻟﻌﻤﺎﻝ ﺍﻷﺣﺪﺍﺙ‬
leave of juvenile workers. The employer may postpone the ‫ ﻭﻳﺘﻌﻴﻦ ﻗﻴﺎﻡ ﺍﻟﻌﺎﻣﻞ ﺑﺈﺟﺎﺯﺓ ﻣﺮﺓ ﻋﻠﻰ ﺍﻷﻗﻞ‬.‫( ﺳﺘﺔ ﺃﺷﻬﺮ‬6) ‫ ﻭﺑﻤﺎ ﻻ ﻳﺠﺎﻭﺯ‬،‫ﺍﻟﻌﻤﻞ ﺫﻟﻚ‬
annual leave of the worker if the interest of the work so ‫ ﻭﻟﺼﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺃﻥ ﻳﺪﻓﻊ ﻟﻠﻌﺎﻣﻞ‬.‫( ﺛﻼﺛﻴﻦ ﻳﻮﻣﺎ‬30) ‫ ﻭﺑﻤﺪﺓ ﻻ ﺗﻘﻞ ﻋﻦ‬،‫( ﻋﺎﻣﻴﻦ‬2) ‫ﻛﻞ‬
requires for no more than 6 (six) months. The worker shall ‫ﺍﻷﺟﺮ ﺍﻷﺳﺎﺳﻲ ﻋﻦ ﺃﻳﺎﻡ ﺍﻹﺟﺎﺯﺍﺕ ﺍﻟﺴﻨﻮﻳﺔ ﺍﻟﺘﻲ ﻟﻢ ﻳﺤﺼﻞ ﻋﻠﻴﻬﺎ ﺇﺫﺍ ﻭﺍﻓﻖ ﺍﻟﻌﺎﻣﻞ ﻛﺘﺎﺑﺔ‬
take leave at least once every 2 (two) years, for a period of ‫ ﻭﻳﺴﺘﺤﻖ ﺍﻟﻌﺎﻣﻞ ﺍﻷﺟﺮ ﺍﻟﺸﺎﻣﻞ ﻋﻦ ﺭﺻﻴﺪﻩ ﻣﻦ ﺍﻹﺟﺎﺯﺍﺕ ﺍﻟﺴﻨﻮﻳﺔ ﺇﺫﺍ ﺍﻧﺘﻬﺖ‬.‫ﻋﻠﻰ ﺫﻟﻚ‬
no less than 30 (thirty) days. The employer may pay the .[81 ‫ ]ﺍﻟﻤﺎﺩﺓ‬.‫ﺧﺪﻣﺘﻪ ﻗﺒﻞ ﺍﺳﺘﻨﻔﺎﺩﻩ ﻟﻬﺎ‬
worker the basic wage for the days of annual leave that he
does not take, if the worker agrees to this in writing. The
worker is entitled to the gross wage for his annual leave
balance if his service ends before exhausting it. [Article 81].

14.The worker, whose illness is proven, is entitled to a sick ‫( ﻣﺎﺋﺔ‬182) ‫ﻳﺴﺘﺤﻖ ﺍﻟﻌﺎﻣﻞ ﺍﻟﺬﻱ ﻳﺜﺒﺖ ﻣﺮﺿﻪ ﺇﺟﺎﺯﺓ ﻣﺮﺿﻴﺔ ﺑﻤﺎ ﻻﻳﺘﺠﺎﻭﺯ‬.14
leave not exceeding 182 (one hundred and eighty-two) .[82 ‫ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻟﻨﺴﺐ ﺍﻟﻤﺸﺎﺭ ﺇﻟﻴﻬﺎ ﻓﻲ ]ﺍﻟﻤﺎﺩﺓ‬،‫ﻭﺍﺛﻨﻴﻦ ﻭﺛﻤﺎﻧﻴﻦ ﻳﻮﻣﺎ ﻓﻲ ﺍﻟﻌﺎﻡ‬
days per year based on percentages which it mentioned on
[article 82].

15.It is permitted to grant the female worker, upon her ‫ﻳﺠﻮﺯ ﻣﻨﺢ ﺍﻟﻌﺎﻣﻠﺔ ﺑﻨﺎﺀ ﻋﻠﻰ ﻃﻠﺒﻬﺎ ﺇﺟﺎﺯﺓ ﺑﺪﻭﻥ ﺃﺟﺮ ﻟﺮﻋﺎﻳﺔ ﻃﻔﻠﻬﺎ ﻟﻤﺪﺓ ﻻ ﺗﺘﺠﺎﻭﺯ‬.15
request, unpaid leave to care for her child for a period not ‫ ﻋﻠﻰ ﺃﻥ ﺗﺘﺤﻤﻞ ﺍﻟﻌﺎﻣﻠﺔ ﻓﻲ ﻫﺬﻩ ﺍﻟﺤﺎﻟﺔ ﻛﺎﻓﺔ ﺍﻻﺷﺘﺮﺍﻛﺎﺕ ﻓﻲ ﺻﻨﺪﻭﻕ‬، ‫ﻋﺎﻣﺎً ﻭﺍﺣﺪ‬
exceeding 1 (one) year, and in this case, the female worker ‫ﺍﻟﺤﻤﺎﻳﺔ ﺍﻻﺟﺘﻤﺎﻋﻴﺔ ﻣﺘﻀﻤﻨﺔ ﻧﺴﺒﺘﻬﺎ ﻭﻧﺴﺒﺔ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻭﺍﻟﺤﻜﻮﻣﺔ ﺧﻼﻝ ﻓﺘﺮﺓ‬
must bear all contributions to the Social Protection Fund ‫ ﻭﺗﻌﺘﺒﺮ ﻫﺬﻩ ﺍﻹﺟﺎﺯﺓ ﺿﻤﻦ ﻣﺪﺓ ﺧﺪﻣﺔ ﺍﻟﻌﺎﻣﻠﺔ ﻭﻻ ﻳﻌﺘﺪ ﺑﺘﻠﻚ ﺍﻟﻤﺪﺓ ﻓﻲ ﺣﺴﺎﺏ‬،‫ﺍﻹﺟﺎﺯﺓ‬
covering her percentage, the percentage of the employer, .‫[ ﻣﻦ ﻫﺬﺍ ﺍﻟﻘﺎﻧﻮﻥ‬61 ‫ﻣﻜﺎﻓﺄﺓ ﻧﻬﺎﻳﺔ ﺍﻟﺨﺪﻣﺔ ﺍﻟﻤﻨﺼﻮﺹ ﻋﻠﻴﻬﺎ ﻓﻲ ]ﺍﻟﻤﺎﺩﺓ‬

16.The worker is entitled to special leave with full pay [ 84 ‫ﻳﺴﺘﺤﻖ ﺍﻟﻌﺎﻣﻞ ﺇﺟﺎﺯﺓ ﺧﺎﺻﺔ ﺑﺄﺟﺮ ﺷﺎﻣﻞ ﺣﺴﺐ ﺍﻟﺤﺎﻻﺕ ﺍﻟﻤﺤﺪﺩﺓ ﻓﻲ ]ﺍﻟﻤﺎﺩﺓ‬.16
according to the cases specified in the article (84) of the ‫ﻣﻦ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﺍﻟﻌﻤﺎﻧﻲ ﻛﻤﺎ ﻳﺴﺘﺤﻖ ﺇﺟﺎﺯﺓ ﺭﺳﻤﻴﺔ ﻓﻲ ﺃﻳﺎﻡ ﺍﻷﻋﻴﺎﺩ ﻭﺍﻟﻤﻨﺎﺳﺒﺎﺕ ﺍﻟﺪﻳﻨﻴﺔ‬

17.Transportation, accommodation, and meals are provided ‫ﻳﺘﻢ ﺗﻮﻓﻴﺮ ﻧﻘﻞ ﻭﺳﻜﻦ ﻭﻭﺟﺒﺎﺕ ﻏﺬﺍﺋﻴﺔ ﻣﺠﺎﻧﺎً ﻟﻠﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﻓﻲ ﺣﺎﻝ ﺗﻜﻠﻴﻔﻪ ﺑﺎﻟﻌﻤﻞ‬.17
free of charge to the second party when assigned to work in .[58 ‫ﻓﻲ ﻣﻨﺎﻃﻖ ﺍﻟﻨﺎﺋﻴﺔ ﺍﻟﺘﻲ ﺗﺤﺪﺩ ﺑﻘﺮﺍﺭ ﻣﻦ ﺍﻟﻮﺯﻳﺮ ]ﺍﻟﻤﺎﺩﺓ‬
remote areas specified by the minister [Article 58].

18.The Labour Law and its implementing ministerial ‫ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ‬،‫ﻋﻨﺪ ﺗﻄﺒﻴﻖ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻳﺮﺍﻋﻰ ﻓﻲ ﺗﺸﻐﻴﻞ ﺍﻟﻨﺴﺎﺀ ﻭﺍﻷﺣﺪﺍﺙ‬.18
decisions shall be taken into account when applying the .‫ﺍﻟﻮﺯﺍﺭﻳﺔ ﺍﻟﻤﻨﻔﺬﻩ ﻟﻪ‬
contract for the employment of women and juveniles.

19.The employer shall, at the end of the work relationship, ‫ﻳﺠﺐ ﻋﻠﻰ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻋﻨﺪ ﺍﻧﺘﻬﺎﺀ ﻋﻼﻗﺔ ﻋﻤﻞ ﺍﻟﻌﻤﺎﻝ ﻏﻴﺮ ﺍﻟﻤﻨﺘﻔﻌﻴﻦ ﺑﺄﺣﻜﺎﻡ‬.19
pay the worker a rewards (gratuity) for his period of service, ‫ ﻻ ﺗﻘﻞ ﻋﻦ ﺃﺟﺮ‬،‫ﻗﺎﻧﻮﻥ ﺍﻟﺤﻤﺎﻳﺔ ﺍﻻﺟﺘﻤﺎﻋﻴﺔ ﺃﻥ ﻳﺆﺩﻱ ﺇﻟﻰ ﺍﻟﻌﺎﻣﻞ ﻣﻜﺎﻓﺄﺓ ﻋﻦ ﻣﺪﺓ ﺧﺪﻣﺘﻪ‬

20.The two parties acknowledge that they have perused the .‫ﻳﻘﺮ ﺍﻟﻄﺮﻓﺎﻥ ﺑﺈﻃﺎﻟﻌﻬﻤﺎ ﻋﻠﻰ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﻭﺍﻟﻠﻮﺍﺋﺢ ﺍﻟﻮﺯﺍﺭﻳﺔ ﺍﻟﻤﻨﻔﺬﻩ ﻟﻪ‬.20

regulations.

21.The Omani Labour Law, implementing decisions, ‫ﻳﺴﺮﻱ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﻭﺍﻟﻠﻮﺍﺋﺢ ﺍﻟﻮﺯﺍﺭﻳﺔ ﺍﻟﻤﻨﻔﺪﺓ ﻟﻪ ﻭﺃﻱ ﺗﻌﺪﻳﻼﺕ ﺗﻄﺮﺃ‬.21
regulations, and any future amendments shall apply unless .‫ﻋﻠﻴﻬﺎ ﻣﺴﺘﻘﺒﻼ ﻋﻠﻰ ﻣﺎ ﻟﻢ ﻳﺮﺩ ﺫﻛﺮﻩ ﺑﻬﺬﺍ ﺍﻟﻌﻘﺪ‬
otherwise stated in this contract.

22.The employment contract shall terminate in any of the :‫ﻳﻨﺘﻬﻲ ﻋﻘﺪ ﺍﻟﻌﻤﻞ ﻓﻲ ﺃﻱ ﻣﻦ ﺍﻟﺤﻼﺕ ﺍﻵﺗﻴﺔ‬.22
following cases:
a.The expiration of its term or completion of the agreed- ‫ﺍﻧﺘﻬﺎﺀ ﻣﺪﺗﻪ ﺃﻭ ﺇﻧﺠﺎﺯ ﺍﻟﻌﻤﻞ ﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻪ‬.‫ﺃ‬
upon work.

b.Termination of the contract by the worker or employer in ‫ﺇﻧﻬﺎﺀ ﺍﻟﻌﻘﺪ ﻣﻦ ﻗﺒﻞ ﺍﻟﻌﺎﻣﻞ ﺃﻭ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻃﺒﻘﺎ ﻷﺣﻜﺎﻡ ﻫﺬﺍ ﺍﻟﻘﺎﻧﻮﻥ‬.‫ﺏ‬
accordance with the provisions of this law.

c.The worker’s inability to perform his work or his death. ‫ﻋﺠﺰ ﺍﻟﻌﺎﻣﻞ ﻋﻦ ﺗﺄﺩﻳﺔ ﻋﻤﻠﻪ ﺃﻭ ﻭﻓﺎﺗﻪ‬.‫ﺝ‬

d.The worker’s illness necessitated his absence from work ‫ﻣﺮﺽ ﺍﻟﻌﺎﻣﻞ ﻣﺮﺿﺎ ﺍﺳﺘﻮﺟﺐ ﺍﻧﻘﻄﺎﻋﻪ ﻋﻦ ﺍﻟﻌﻤﻞ ﻣﺪﺓ ﻣﺘﺼﻠﺔ ﺃﻭﻣﻨﻔﺼﻠﺔ ﻻ ﺗﻘﻞ ﻋﻦ‬.‫ﺩ‬
for a continuous or separate period of not less than (3) (3) ‫ ﺷﺮﻳﻄﺔ ﺍﺳﺘﻨﻔﺎﺩ ﻣﺪﺓ ﺍﻹﺟﺎﺯﺓ ﺍﻟﻤﺮﺿﻴﺔ ﺍﻟﻤﻨﺼﻮﺹ‬،‫ﺛﻼﺛﺔ ﺃﺷﻬﺮ ﺧﻼﻝ ﻋﺎﻡ ﻭﺍﺣﺪ‬
three months within one year, provided that he exhausts ‫ [ ﻣﻦ ﻫﺬﺍ ﺍﻟﻘﺎﻧﻮﻥ ﻭﺭﺻﻴﺪﻩ ﻣﻦ ﺍﻹﺟﺎﺯﺍﺕ ﺍﻻﻋﺘﻴﺎﺩﻳﺔ‬82 ‫ﻋﻠﻴﻬﺎ ﻓﻲ ]ﺍﻟﻤﺎﺩﺓ‬
the period of sick leave stipulated in Article (82) of this law
and his balance of regular leave.

23.Labor dispute claims arising from claims for the rights ‫ﻻ ﺗﻘﺒﻞ ﺩﻋﺎﻭﻯ ﻣﻨﺎﺯﻋﺎﺕ ﺍﻟﻌﻤﻞ ﺍﻟﻨﺎﺷﺌﺔ ﻋﻦ ﺍﻟﻤﻄﺎﻟﺒﺔ ﺑﺎﻟﺤﻘﻮﻕ ﺍﻟﻤﻨﺼﻮﺹ ﻋﻠﻴﻬﺎ‬.23
stipulated in Oman labor law and the employment contract ‫ ﺇﺫﺍ ﺭﻓﻌﺖ ﺍﺑﺘﺪﺍﺀ ﺇﻟﻰ ﺍﻟﻤﺤﻜﻤﺔ ﺍﻟﻤﺨﺘﺼﺔ ﺩﻭﻥ ﺗﻘﺪﻳﻢ ﻃﻠﺐ‬،‫ﻓﻲ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﻭﻋﻘﺪ ﺍﻟﻌﻤﻞ‬
shall not be accepted if they are initially filed with the ‫ ﻟﻴﺘﻮﻟﻰ ﻣﺴﺎﻋﻲ ﺍﻟﺘﺴﻮﻳﺔ ﺑﻴﻦ‬،‫ﻟﻠﺘﺴﻮﻳﺔ ﺇﻟﻰ ﺍﻟﺘﻘﺴﻴﻢ ﺍﻹﺩﺍﺭﻱ ﺍﻟﻤﺨﺘﺺ ﻓﻲ ﺍﻟﻮﺯﺍﺭﺓ‬
competent court without submitting a request for settlement ‫( ﺛﻼﺛﻮﻥ ﻳﻮﻣﺎ ﻣﻦ‬30) ‫ ﻭﺫﻟﻚ ﺧﻼﻝ ﻣﺪﺓ ﺃﻗﺼﺎﻫﺎ‬،‫ﺃﻃﺮﺍﻓﻬﺎ ﻭﻓﻘﺎ ﻷﺣﻜﺎﻡ ﻟﻘﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ‬
to the competent administrative division in the Ministry, to .[9 ‫ ]ﺍﻟﻤﺎﺩﺓ‬.‫ﺗﺎﺭﻳﺦ ﺗﻘﺪﻳﻢ ﺍﻟﻄﻠﺐ‬
undertake settlement efforts between the parties thereto in
accordance with the provisions of the Labor Law, within a
maximum period (30) Thirty days from the date of
submitting the application. [Article 9].
