This MEMORANDUM OF DEPOSIT OF TITLE DEEDS executed at Barur this
the 28th May 2025

Mrs. KALAIMANI R (Aadhaar No. 537645264530, PAN No.LRNPK3638P, Mob
No.9150374437) W/o K. RAJENDRAN, Aged about 46 years residing at D.NO- 3/714,
Kavapatti - Village, Maruderi - Post, Krishnagiri - 635204. Hereinafter called the
‘Mortgagor’, which term wherever the context mean and include his/her/their heirs,
executors, administrators, legal representatives and assigns,
To and in favour of
M/s. REPCO HOME FINANCE LIMITED, a Company registered under the Companies
Act, 1956 and having its registered Office at “REPCO TOWER” No.33, North Usman
Road, T.Nagar, Chennai - 600 017 hereinafter called “RHFL/MORTGAGEE”, which
expression shall unless the context otherwise requires, include its successors and
assigns, having branches amongst others at Krishnagiri represented by its Branch Senior
Manager Mr. K. Sathiraj (Employee No. E000626, having office at No.2/34-5 First
Floor, Rajaji Nagar East, Rayakottai Main Road, Krishnagiri-635001.
WHEREAS Mrs. KALAIMANI (Aadhaar No. 537645264530, PAN
No.LRNPK3638P, Mob No.9150374437) W/o K. RAJENDRAN, Aged about 46
yearshas/have applied for a loan of Rs. 24,10,545/- (Rupees Twenty-Four Lakhs Ten
Thousand Five Hundred Forty-Five only) for the purpose of Construction of House
and whereas RHFL is willing to advance / already advanced the said loan and the
Mortgagor has agreed that the repayment of the said loan of Rs. 24,10,545/- (Rupees
Twenty-Four Lakhs Ten Thousand Five Hundred Forty-Five only) shall be secured
by deposit of title deeds of immovable property belonging to him as security, more fully
described in Schedule “B” hereunder, thereby creating an equitable mortgage over the
same.
Now this Memorandum of Deposit of Title Deeds witnesseth that in consideration of the
sum of Rs. 24,10,545/- (Rupees Twenty-Four Lakhs Ten Thousand Five Hundred
Forty-Five only) to be advanced / already advanced by RHFL and as security for the
due repayment of the said sum of Rs. 24,10,545/- (Rupees Twenty-Four Lakhs Ten
Thousand Five Hundred Forty-Five only) together with interest and other monies
thereon that become due and payable, the Mortgagor on 28-05-2025 deposited with
RHFL at their Branch at Krishnagiri the Title Deeds more fully described in the
Schedule “A” hereunder as security thereby intended to create an equitable mortgage
by deposit of title deeds of the said Property together with all structures standing
thereon in favour of RHFL to secure the loan of Rs. Rs. 24,10,545/- (Rupees Twenty-
Four Lakhs Ten Thousand Five Hundred Forty-Five only) due and owing by the
Mortgagor, including interest, penal interest, costs, charges and other monies that
become due and payable from time to time to RHFL and all other amounts payable by
him/her/them in connection with protection and preservation of the property(ies) and the
enforcement and realization of the security created and the security shall always remain
as a continuing security to RHFL until all amounts outstanding are paid to the RHFL in
full and that the security shall be a security for discharge of the said loan or any other
loans availed by the Mortgagor(s)/Executant(s)/Borrower(s).
The Mortgagor(s)/Executant(s) declares that apart from the said title deeds more fully
described in the SCHEDULE “A” hereunder, he/she/they did not have in his/her/their
possession, power or control any other title documents pertaining to the security more
fully described in SCHEDULE “B” hereunder. The Mortgagor(s)/Executant(s)
declares that no notice of acquisition or requisition has been issued or received or
published in respect of the security property(ies) and no adverse claim has been made
against the security property(ies) or any part thereof nor was the security property(ies)
reserved for any purpose. The mortgagor further declare and confirm that he/she/they
have not entered into any agreement for sale of the property(ies) or any part thereof or
not given as security or otherwise agreed to alienate or dispose off the security
property(ies) or any part thereof and no proceedings were pending or had been
initiated against him/her/them or attachments or warrants/summons has been served or
issued in respect of Sales Tax, Income Tax, Government revenues or other taxes or
under any law in force in India. The Mortgagor(s)/Executant(s) hereby, covenants that
the said property is not subject to any prior mortgage, Lien, charge, pending litigation
or any other kind of encumbrance whatsoever and that he, the
Mortgagor(s)/Executant(s), is/are the absolute owner of the same and is well truly
seized of the property(ies). The Mortgagor(s)/Executant(s) further agrees to keep
RHFL indemnified against all claims and demands whatsoever by any person lawfully
or equitably claiming under him and by any other person whomsoever. Any
typographical mistakes or inadvertent technical and grammatical errors or incorrect
punctuation may be construed in the prospective of the whole transaction/intention of
the mortgage considering as relevant in this regard. The Mortgagor(s)/Executant(s) has
/ have agreed that the intention of creating the mortgage against the immovable
property in favour of RHFL shall prevail ignoring any inadvertent error which might
have come to be mentioned in this deed and the final interpretation or the decision of
omitting such redundant technical errors are finally vested with the RHFL
unconditionally within the meaning and scope of the mortgage.
