Introduction
The Privacy Conversation

Privacy is dead. There should be no doubt whatsoever about that. We live in


a society that constantly generates vast quantities of human information—​
information about you, me, and everyone we know. This information is
in turn tracked, screened, and sorted by corporations and governments
and shared exponentially to others. Ad networks monitor our web-​surfing
to send us “more relevant” ads. The National Security Agency screens our
email activity for signs of radicalism. Schools track student sleep and ac-
tivity patterns; CCTV cameras watch every street corner and traffic light;
and drones have appeared in our skies. Vast databases of human informa-
tion are assembled for purposes of “training” artificial intelligence programs
designed to predict everything from traffic patterns and virus contagion to
the location of undocumented migrants. We spy on the activities of loved
ones, whether though “Find My Friends” or by tracking everything they do
and say with their cell phones. We’re even tracking ourselves, using personal
electronics like Apple watches, Fitbits, and other gadgets that have made the
“quantified self ” a realistic possibility.
Privacy’s death has fittingly been a public one. Commentators and scholars
have bemoaned the Death of Privacy at length. One 2017 New York Times
article suggested that massive data breaches like the one suffered by credit
broker Equifax signal “the end of privacy.”1 Such statements are treading well-​
worn ground. At the launch of Sun Microsystems’ Jini technology in January
1999, Sun CEO Scott McNealy famously declared, “You have zero privacy
anyway. Get over it.”2 McNealy’s outburst made headlines at the time, and it
continues to be quoted today by technologists, journalists, and academics,
even as Jini (and Sun itself) have faded over the horizon of our memories.
Many others agree. At a Federal Trade Commission event in 2013, Vint Cerf,
a leading figure in the creation of the internet and Google’s “chief internet
evangelist,” suggested that privacy might be a historical anomaly.3 Pulitzer
Prize-​winning journalist Thomas Friedman infamously declared in 2014

that “privacy is over.”4 Facebook founder Mark Zuckerberg was more blunt,
declaring in his peculiar and self-​serving way that privacy was no longer a
“social norm.”5 To repeat: privacy is dead, or at a minimum, it is dying.
That’s the conventional wisdom, anyway. It’s something I hear a lot. In fact,
it’s part of a conversation I’ve had so many times that I’ve started calling it
just “The Privacy Conversation.” I’ve had The Privacy Conversation with
my colleagues and students, with taxi drivers and waiters, with barbers and
bartenders. I’ve had it with family and friends, and I’ve had it with people I’ve
met in line at airports and baseball stadiums while we waited to go through
privacy-​invasive metal detectors. I have The Privacy Conversation about
once a week, and it goes something like this.
I’ll be chatting with someone—​usually someone I’ve just met—​and they’ll
ask me what I do. “I’m a law professor,” I explain, and then they’ll ask what
kind of law I teach. Before the words “privacy law” even pass my lips, I know
what’s coming. There’s going to be a pause, and they’re going to say one of
two things. Sometimes they’ll jokingly say something like “Well, you must be
very busy then!” But other times, the more interesting times, something else
happens. They’ll say something like “Well, there is no privacy anymore, is
there?” And then there’s another pause and a funny noise. It sounds a bit like
a cough and a bit like a laugh, but it’s more of a sad sound than a happy sound.
It’s a wistful sound, as if they are lamenting the Death of Privacy, lamenting
the end of something they hardly appreciated before it was gone.
Then it’s my turn to talk. (Though it’s hard for a law professor, I try to be
brief.) I explain that “Privacy Is Dead” is a myth, and a self-​serving one at
that, put forth by companies and governments that have lots to gain if our
belief in privacy is lost. The Privacy Is Dead idea is false on its own terms.
Our technologies collect lots of personal information, but lots of things are
still private. We still wear clothes to cover our naked bodies; we still lock the
doors to our homes (and our bedrooms and our bathrooms); we still keep
secrets; and we still care about privacy. Besides, it’s just not the case that all
digital information is known to everyone. We might talk about our informa-
tion being “out there,” but most information exists in the vast intermediate
spaces between being wholly private and wholly public.
More important, this Privacy Is Dead talk masks the real interests at
stake: control of our digital society. We live in a society in which information
is power, and “privacy” is the word we use to talk about the struggles over
personal information, personal power, and personal control. If we think of it
this way, privacy is very much alive—​but very much hanging in the balance.

We use privacy talk to try to come to grips with the tremendous changes in
our society wrought by technologies running on human information, as well
as our own places in that society. The rules for the collection and use of our
information aren’t settled yet. But ordinary people are disempowered. Most
of us lack sufficient knowledge about the technologies and the dense privacy
policies and similar legal agreements that control ever more important parts
of our lives. And even if we knew more, most of us would still lack the power
or technical skills to do anything about it. That’s why many of us feel that our
privacy—​our ability to have a say over our human information—​is slipping
away, running through our fingers like so many fine grains of sand.
At the same time, the flow of our human information has become one of
the most important building blocks of our increasingly digital society. It’s
become a cliché in the technology community to call personal data—​your
data—​“the new oil.”6 From this perspective, human information is the fuel of
the information economy: just as the Industrial Age’s engines (cars, planes,
and factories) ran on oil, so too do the Information Age’s engines (social
networks, GPS navigation software, and ad-​targeting algorithms) run on
data. It follows, insist the “new oil” evangelists, that access to human infor-
mation is as essential to our information economy as access to oil was to our
industrial economy. From this perspective, the processing of human infor-
mation is inevitable, and privacy is just another old-​fashioned, outdated con-
cept that stands in the way of Progress.
I disagree: privacy isn’t dead, nor should it be. But privacy is up for grabs.
Our conversations about privacy are just the lively battleground over this
“new oil” of personal information. They are fights over social power because
information is power, and in any society, information about the people in it
confers social power.
Viewed from this perspective, privacy matters. How we talk about privacy
matters. And how we think about privacy matters. Privacy is about more
than just keeping human information unknown or unknowable. It’s certainly
more than the ability of individuals to “control” access to that information.
Put simply, privacy is about power. Privacy is about the rules governing the
extent to which human information is detected, collected, used, shared, and
stored and how those activities can be used to affect our lives. It’s not just
about who knows what about us, but about what rules apply to what they
know. Thus, a “secret” is still a secret once it is shared with a confidant, and we
still continue to care about what we share. Similarly, our data can remain pri-
vate even when we share it with companies. After all, their “privacy policies”

detail not just what information is collected about us but what the company
will (and won’t) do with that information. In an age of data, privacy rules
are the rules that govern the flows of human information—​the information
about our beliefs, our aspirations, and every moment of our lives.
The battle for privacy isn’t over. As we’ll see, it’s a battle that has been raging
in one form or another for almost 150 years. If anything, it’s a battle that’s just
beginning as more kinds of human information are collected and assembled,
from internet reading and viewing habits to smartphone location data, and
from Fitbit activity and sleep pattern data to the unique genetic codes locked
inside our cells. But if we accept the fatalist myth that Privacy Is Dead (or
its self-​serving cousin, that “data is the new oil”), if we think about privacy
as outdated or impossible, if we think about our information as inevitably
“out there” and beyond human or social control, we will have given up. This
fatalist view of privacy is irresponsible, and it’s destructive. We should not
cede our power and responsibility to help set reasonable rules for the collec-
tion, use, storage, and sharing of our human data. If we do give up, our digital
revolution will have few rules governing information. In such an anarchic
society, as in any anarchy, only the powerful will prosper, while the digitally
disempowered will become even more so.7
Because privacy is up for grabs, we need to better explain what it is and
what it can do for us. We need to identify when we must protect against
the collection or exploitation of personal data, and when we should let the
data flow. The “new oil” way of thinking about privacy is problematic, but
even on its own terms it doesn’t prove that privacy is dead. Just as we did
with the “old oil” of petroleum, we need to know when human informa-
tion should be produced and how (and in whose interests) its power should
be harnessed. We need to know how to protect against the equivalent of
oil spills, air pollution, and potentially cataclysmic climate change. We are
of course still dealing with many of these Industrial Age problems many
decades later, but at least we have a sense of what they are. When it comes
to the Information Revolution, though, we are only just starting to ask the
right questions rather than developing good answers to those questions. We
need to spark and engage in a sustained and meaningful discussion about
Why Privacy Matters, and we need to engage the public, because the future
of privacy is the future of our society. Such questions are simply too im-
portant to be left to academics, technologists, and lawyers, and especially
too important to be left to government security services or the companies
making vast fortunes from our data.

This book is a longer form of what I say when I have The Privacy
Conversation. It’s my contribution to the debate we must continue to have
about privacy, data, and the rules undergirding the infrastructure of our dig-
ital society. At its most basic, this book explains what privacy is and why we
should care about it. My argument is simple: we need to put the misleading
story of the Death of Privacy to one side, and we need to think more clearly
about how technologies of human data can both make our lives better and
make them worse. As with so many human inventions, we need to craft rea-
sonable rules and protections so that we can maximize the good things about
these technologies and minimize the bad things. And those rules should,
first and foremost, serve human values that make our lives better, both as
individuals and as members of society.
Right now, when we talk about these issues in the United States, in Europe,
in Britain, or anywhere else, it can seem like the deck is stacked against pri-
vacy. Calls for privacy regulation are met with arguments that privacy rules
get in the way of other good things, like “security”—​the prevention of crime,
fraud, or terrorism. Others argue that privacy can threaten “innovation,” that
magical term from Silicon Valley’s PR departments evoking a religious faith
in Progress toward a technological utopia. Security and innovation can both
be very good things, but privacy can be a very good thing, too. Unlike secu-
rity or innovation, though, privacy often gets marginalized, seen as a back-
ward or old-​fashioned value, or maybe just something vague and poorly
understood.
In this book, I will show that privacy is neither backward nor old-​
fashioned; in fact, I will show how a meaningful measure of privacy is essen-
tial to any digital society that reasonable humans would want to live in. But
privacy is poorly understood; it can mean many things, and people talking
about privacy often talk at cross purposes to one other. Hence this book, in
which I’ll try to help us understand privacy better. I’ll explain what privacy is
and what it isn’t. I will show what privacy can do for us, why privacy matters,
and how privacy will continue to matter far into the digital future. Along the
way, I’ll also show that it’s not only “privacy” that we talk about in vague and
sloppy ways; we also talk about “innovation” and “security” that way, too. We
need to be clearer about what we mean when we use these words, especially if
we want to build a digital future that is innovative and secure and has reason-
able and fair rules regulating human information. If we’re clear about why
we’re protecting human information, then we can make intelligent decisions
that guide our human information policy. And only then can we properly

make some of the inevitable trade-​offs between and among privacy, security,
and innovation.
So why does privacy matter? What are we trying to protect when we talk
about privacy protection through law, technologies like encryption, or so-
cial and ethical norms? Put simply, privacy matters because it helps us to de-
velop our identities, it allows us to exercise political freedom and it protects
us as consumers. But to begin with, it’s important to understand that privacy
protections shouldn’t be absolute; we need to have a mix of rules that keep
things private and rules that allow information to flow, whether that infor-
mation is facts reported by a free press or personal data deployed to make our
lives better (something that certainly does happen, though far less often than
Silicon Valley might have you believe). We shouldn’t want perfect security—​
perfect security is not only impossible, but down that path lies both enor-
mous inconvenience as well as the specter of a pervasive police state. Nor
should we want unfettered innovation of everything in society. Criminals
and terrorists can be innovative; companies and foreign governments that
disrupt our democratic processes are too. The iPhone was an innovation;
so too were nerve toxins, nuclear weapons, and attempts to manipulate re-
cent U.S. elections by Russia and Cambridge Analytica. Similarly, privacy
shouldn’t be seen as something that is always a good thing in and of itself.
As a philosopher might put it, privacy isn’t an intrinsic good but an instru-
mental value. Privacy shouldn’t be thought of as an end in itself. Instead we
should think of it as something we want because it enables other valuable
opportunities, states of well-​being, and human values that we can talk about
without referring to the vague word “privacy.” In this book I’ll show how pri-
vacy can promote and safeguard lots of things that any decent society should
care about. There are many of them, but I’ll focus on the three I think are par-
ticularly important: identity, freedom, and protection.
Let me say a little bit about these three instrumental privacy values before
we go any further. Privacy rules can promote identity formation because pri-
vacy can help us to figure out who we are and what we believe, by ourselves
and with our intimates and confidants. In my previous book, Intellectual
Privacy, I argued that a special kind of privacy (the intellectual privacy of
the title) is necessary in a democracy because it allows us to develop our po-
litical beliefs free from the skewing effects of being watched, monitored, and
judged.8 Intellectual privacy secures the intellectual freedom to figure out
what we believe about the world and our place in it. Intellectual privacy is
essential to the development of our identities, but it is not the only kind of
