Beneficiary and FIDELITY NATIONAL TITLE as Trustee, and recorded December 28, 2006 as
instrument number 2006-0923505 in book xx, page xx of Official Records in the office of the Recorder
of San Diego County, California. MIN 100389600611220027.
Pursuant to California Civil Code Section 2943(b), the undersigned hereby requests that you deliver to
the undersigned, within 21 days after receipt of this demand, the following documents:
1. A true, correct, and complete copy of the wet-ink signed promissory note, with any modification
thereto executed on December 19, 2006, by Patrick Walsh and payable to SUMMIT LENDING
SOLUTIONS, INC in the principal sum of US$1,181,250.00, and secured by the above Deed of
Trust.
2. A written beneficiary statement setting forth all those matters required by Section 2943 of the
California Civil Code concerning the above promissory note.
3. A copy of the above Deed of Trust and all evidence of any recorded substitutions, recorded
assignments etc. that affect the aforementioned Deed of Trust to the present date.

You're failure to deliver the requested documents or failure to respond/rebut within 21 days after receipt
of this demand will be your attestation that MERS has never had any legal or beneficial interest in the
promissory note, loan instrument, and mortgage indebtedness underlying the security instrument for
which it serves as "nominee" in the above referenced Deed of Trust.
