SUBMISSION RELEASE FORM

I am submitting the material (“Material”), which is an original script / screenplay /story / lyrics /
sound recording / or any other work namely “SAKSHAM” to Contagious Online Media Network
Private Limited (“COMNPL”). The following shall constitute an agreement between me and
COMNP for the submission of the Material (“Agreement”), which shall be submitted on the
following conditions:

1. Submission and review: I request COMNPL to review and evaluate the Material to decide
whether COMNPL will undertake efforts to acquire all or parts of the said Material. I shall
not be entitled to any compensation from COMNPL unless COMNPL decides to use the
Material with or without changes, at the sole discretion of COMNPL.

2. No fiduciary or confidential relationship: I further understand that COMNPL would refuse

to accept and evaluate Material in the absence of my acceptance of each and all of the
provisions of this Agreement. I acknowledge that no fiduciary or confidential relationship
now exists between COMNPL and me, and I further acknowledge that no such relationships
are established between COMNPL and me by reason of this Agreement or by reason of my
submission to COMNPL of the Material.

3. Similarity to other material: I acknowledge that COMNPL is a prominent and a well reputed
production company in the entertainment industry and COMNPL/its
associates/employees/consultants constantly create(s), receive(s) and develop(s) or otherwise
acquire(s) material or elements, including not limited to, unsolicited submissions, that may be
similar or identical to the Material. In the event there are any similarities or elements of
similarities to such other materials submitted to or developed by COMNPL I shall not be
entitled to any compensation from COMNPL and/or I shall not seek to enforce any other right
or action against COMNPL in relation to the Material.

4. Original Work: Unless otherwise disclosed in Annexure A, I represent and warrant that (i) I
am the author of the said Material and the sole copyright owner of the Material and all
elements thereof, (ii) the Material does not violate any copyright, proprietary rights or other
rights of any person or entity, and (iii) no third party has any rights, title or interest therein or
thereto.

5. Indemnity: I hereby agree to defend, indemnify and hold harmless COMNPL (and its
officers, directors, employees and representatives) against and for any and all claims,
liabilities, damages, costs and expenses arising from or related to the Material, including the
use thereof by COMNPL, or any breach of any undertakings, representations or warranties
and obligations given by me herein.

6. Dispute resolution: Any and all claims, disputes, questions or controversies involving the
parties to this Agreement and arising out of or in connection with this Agreement, or the
execution, interpretation, validity, performance, breach or termination hereof shall be referred
to arbitration in Mumbai in accordance with Indian Arbitration and Conciliation Act, 1996.
The number of arbitrators shall be one (1) and the appointment of such arbitrator shall be
mutually decided. The language of arbitration shall be English.
 7. Timeline and return of Material: I agree that COMNPL shall have the right to review and
confirm the Material (whether in whole or in part) for a period of 90 (ninety) days from the
date of the submission of the Material with COMNPL or if the Material is rejected by
COMNPL in writing, whichever is earlier. I understand and agree that in case I don’t receive
any intimation from COMNPL within the aforesaid 90 (ninety) days of submission of the
Material, it will be deemed to have been rejected and COMNPL shall not be obligated to
notify me of such rejection or to return the Material to me. I have retained at least one copy
of the Material, and I release COMNPL from any and all liability for loss or other damage to
the copies of Material submitted hereunder.

8. Mode of submission: The Material shall be submitted by hand or by delivery at the 90/8,
Patani Business Center, Croass Road ‘A’, MIDC, Andheri East, Mumbai 400 093 or by
electronic mail at [scripts@theviralfever.com].

9. Formal written agreement: I further agree that no other obligations exist or shall exist or be
deemed to exist unless and until a formal written agreement has been entered into by and
between COMNPL and me, and the rights and obligations of each of COMNPL and me shall
be expressed in said formal written agreement. The compensation for my services shall be
mutually agreed and shall form part of such written agreement.

10. Severability: If any provision in this Agreement becomes invalid or illegal or adjudged
unenforceable, the provision shall be deemed to have been severed from this Agreement and
the remaining provisions of this Agreement shall not, so far as possible, be affected by the
severance.

11. Governing Law: Subject to clause 6 above, the courts in Mumbai shall have exclusive
jurisdiction. This Agreement shall be governed by and construed in accordance with the laws
of India.

12. Entire understanding: This Agreement supersedes all prior agreements and arrangements
and constitutes the entire agreement between the parties hereto with respect to the subject
matter hereof and no addition to or variation of any of its terms shall be valid unless in writing
and signed by a person duly authorized on behalf of myself and COMNPL respectively.
