Preliminary Statement
1. This report completion ofa Command Investigation conducted, in accordance with reference
(a) and enclosure (1), into allegationsofattempted solicitation with a minor by {I R)
n or about 15 July 2023. The matter was first referred to Naval Criminal
Investigative Service (NCIS) to which they expressed no interest in retaining the case. However,
there was no legal objection to proceeding with the investigation from NCIS or Carrier Strike
Group NINE (CSG 9)Staff Judge Advocate. All reasonably available relevant evidence was
collected. The directive and special requirements articulated in enclosure (1) were met.
Findings of Fact
1. On 27 May 2023, [messaged whom fe believed to be a
pr the app Whisper. s a fake underage[gir] real name] (Last name
unknown) in conjunction with the Instagram page Jans_Against_Predators as shown in
enclosure (6). The subject did not knowFiclwas speaking to said decoy and continued to do so
on andofffor approximately two months, as shown in enclosure (5)
2. Enclosure (5), igure 2 sates that ore es underage and
about toturnfifteer] in August and asked if[ig was “ok with it.” The subject proceeded to call
the[fourieen-year-old cute and continued to exchange information with the decoy on Whisper
until exchanging numbeg shown in enclosure (5), figure 6. The number
provided correlates with] hone number in enclosure (5), figure 7.
3. provided the rest of the text messages to the Command
Investigator Shown enclosure (5). The subject sated name was ln enclosure (5),

Recommendations
1. Recommend proceeding to Non-Judicial Punishment (NIP) for violation of Uniform Code of
Military Justice (UCMJ) Article 80, attempted violationofarticle 134 (indecent language) in
accordance with reference (b). Due to the fact thatfilllllwas not actually an underage EF} the
article 134 violation was merely an attempt. The conversations fg had with whom thought to

forces and that discredit was amplified by the large social media footprint
