THE 2017 CONSTITUTION OF THE
CAROLINIAN POLITICAL SCIENCE SOCIETY

PREAMBLE

We, the bona fide Political Science Majors and proud


members of this Organization, in maintaining the
Carolinian identity of being Witnesses to the Word, build
a mature, god-fearing, and responsive society, promote
holistic education with a mission, and aim on the ideals
and aspirations of our country, do ordain and promulgate
this Constitution.

ARTICLE I
Name of Organization
Section 1. The organization shall be officially known as the Carolinian Political
Science Society.
Section 2. Any change in the name of the Organization shall be introduced through
a resolution of the council and shall be approved by a 2/3 vote of the general
assembly.

ARTICLE II
Domicile
The domicile of the Carolinian Political Science Society shall be at the
Department of Political Science, University of San Carlos, Cebu City, Cebu,
Philippines.

ARTICLE III
Seal
Section 1: There shall be an official seal which shall be used by the Organization in all
of is official transactions and documents.
Section 2: Any change of the official seal shall be introduced through a resolution of
the Council and shall be approved by a two-thirds vote of the general assembly.

ARTICLE IV
Organization Principles and Policies
Section 1. The Organization is a co-curricular organization of the Department of Political
Science embodying the principles of democracy and republicanism.

Section 2. The Organization's prime objective is to promote the holistic development of


its members in adherence to the generally accepted principles of fraternity, equality, and
liberty of its members.

Section 3. The Organization adheres to the thrust promoting the Carolinian political
science majors’ identity of being evidence-based lifelong learners steering governance.
Its programs and policies shall we directed to this end.

Section 4. The Society adopts as one of its policies, the formation of politically aware,
mature and responsive citizenry. Towards this end, the Society shall take an active part
in local and national issues that concern the general welfare of the Filipino people.

Section 5. The Society values the dignity of its members and guarantees full respect for
their rights granted by this Constitution.

Section 6. The Society adheres to the principles of inclusiveness. Towards this end, it shall
encourage the involvement of all its members in all its activities.

Section 7. The CPSS has the authority to establish measures against unreasonable acts
and practices that would hinder the performance and administration of duties of its
officers.

Section 8. It is the policy of the Society to discourage acts and practices that prescribe or
improve political doctrine through force, undue influence and intimidation.

Section 9. As a democratic Society, it is the policy of the organization not to vitiate in


any manner or extent the free enterprise of ideas and expression among its members.

Section 10. The Society shall take measures to preserve and protect a healthy ecological
balance.

ARTICLE V
MEMBERSHIP
Section 1. All bona fide Political Science Majors enrolled in the University of San Carlos
shall, ipso facto, become members of the Organization.

a. All shiftees and transferees shall, by their enrollment to the academic


program, be recognized as members of the Organization.
Section 2. Membership may be lost in the manner prescribed by the by-laws, or in the
following instances:
a) By shifting to any other major field of study.

b) By transferring to other educational institutions.

c) By the time a member completes his/her undergraduate studies in the field of


Political Science.

d) Discontinuance of the study.

e) Expulsion
ARTICLE VI

Rights

Section 1. It is the right of every member to avail of any benefits and privileges
the Society extends to its members.
Section 2. Every member shall have the right to equal treatment and
protection.
Section 3. Excessive fees and fines shall not be imposed.
Section 4. Members have the right to express their views on matters
concerning the Society and shall have the opportunity to be heard by the
body.
Section 5. The right of every member to be properly informed on matters
concerning the Society shall be recognized. Access to official acts,
transactions or decisions shall be inviolable.
Section 6. It is the right of every member to peaceably assemble and petition
the officers of the Society for redress of grievances.
Section 7. Any member under investigation shall have the right to due process.
No force, undue influence and intimidation or any other means which vitiate
free will shall be sued against him or her.
Section 8. The right to form, join and participate in other associations having
purposes not contrary to laws and policies of the Society, the University, and
the Republic of the Philippines shall be inviolable.
Section 9. It shall be the right of every member of the Society to vote in the
CPSS elections, plebiscites and referenda.

ARTICLE VII
Duties and Obligations
Section 1. It shall be the duty of every bona fide member of the Organization
to live by the values of a true Carolinian by ardently upholding the
Organization’s Constitution and bylaws, and contribute to the fulfilment of its
goals and objectives.
Section 2. It is the duty of the members to exercise their rights with
responsibility.
Section 3. It shall be the duty of all the members to keep themselves informed
of any matter concerning the Society, and to actively participate in any
meeting, activity or program duly sanctioned by it.
Section 4. It shall be the duty of all members to pay the respective dues and
fines duly imposed upon them by the Society.
a. All members must, however, be informed of any impending dues to
be paid.
b. No member shall be barred from his enrollment in the academic
program on the grounds of his failure to pay the dues and fines, if the
excuse behind it is valid.
Section 5. It shall be the obligation of every member of the Organization to
vote in the Organization’s elections, plebiscites and referenda.

ARTICLE VIII
The CPSS Council
Section 1. The CPSS Council shall be composed of all officers, elected and
appointed.
Section 2. The Council shall be composed of the President, the Vice-president,
9 councilors elected at large, 2 batch representatives elected by their
respective year levels, 1 representative per track and an appointed General
Secretary and Undersecretary.
Section 3. The CPSS council shall regularly meet twice every month, with the
power of the president to hold a special session with proper notice to the
officers at least three days prior to the date of the same.
a. All members of the Organization shall be given the right to observe
all meetings of the Council, provided that he follows the prescribed
decorum and house rules governing such meetings.
Section 4. Chairs and/or any members of the ad-hoc committees duly
recognized by the chairpersons of a standing committee may appear and
participate in the meeting.

ARTICLE IX
The Officers
Section 1. The officers of the Society shall include the following: President,
Vice-President, nine (9) councilors who shall be elected according to the
standing committee they wish to represent, two (2) elected Representatives
from each of the year levels and the four (4) track representatives, who are ex-
officio members. These officers shall compose the CPSS Council.
Section 2. The Council shall be composed of an executive and legislative
branch.
Section 3.
a. Executive branch shall be composed of a President, Vice-President,
Batch Representatives, General Secretary and Undersecretary
b. Legislative branch shall be composed of councilors and track
representatives
Section 4. The General Secretary and Undersecretary shall be appointed by the
President in his/her discretion.
Section 5. All officers of the Organization shall have a voting power except the
appointed officers.
Section 6. The President shall have the following duties and functions:
a. To serve as the official representative of the Society;
b. To call and preside over all assemblies and affairs of the Society;
c. To call and preside over all CPSS Council meetings;
d. To manage and supervise the programs and activities of the Society;
e. To appoint the Secretary of the Society; and
f. To exercise such duties and functions as may be delegated to him/her
subject to the limitations of the Constitution.
Section 7. The Vice-President shall have the following duties and functions:
a. In the absence or incapacity of the President, to represent the Society
on appropriate occasions;
b. In the absence or incapacity of the President, to call and preside over
all assemblies and council meetings;
c. To assist the President in all programs and activities of the Society;
d. To assume the supervision of the external activities of the Society; and
e. To have such functions as may be delegated to him/her subject to the
limitations of this Constitution.
Section 8. The nine (9) Councilors and the four (4) track representatives shall
have the following duties and functions:
a. The Councilors shall serve as the chairperson or vice-chairpersons of the
nine (9) Standing Committees, shall be eligible for membership to two other
Standing Committees, and shall assume the responsibilities therein.
b. The four (4) track representatives must be a member of the following tracks:
1) Law and Policy Studies 2) Public Management and Development 3) Political
Theories and Systems 4) International Relations and Foreign Service, duly
elected by its members.
d. The track representatives shall sit as Ex-Officio members of the council and
shall be accorded with voting powers. They are also eligible for memberships
in the standing committees appertained in Article X, Sec. 1 of this Constitution.
e. Their role is to present to the Council the respective activities of their track
organization for coordination but not necessarily submitted to the Council for
approval. Only if the activity can affect or jeopardize the interest of CPSS shall
it be placed into vote.
f. The activities of the track organizations are expected to help the Majors in
achieving holistic development.
g. All activities of track organizations must be spearheaded in partnership with
the CPSS. Proponents or organizers are free to coordinate and seek assistance
from the different standing committees.
h. To facilitate an orderly and systematized manner of succession in case of
vacancy in the position of a track representatives, this will be the structure in
all track organizations:
EXECUTIVE BODY: Chief Executive & Deputy Chief Executive
IMPLEMENTING COMMITTEES: May be composed of different positions
necessary and adequate to facilitate the needs of the organization
i. Titles or names of the different positions (e.g. protocol officer, major general,
etc.) are left to the discretion and judgment of the different track
organizations. This is seen as an avenue to show their innovativeness and
maintain the relevance of their organization to their respective tracks.
Section 9. In case of death, permanent disability, removal from office,
suspension, or resignation of the President during the regular semesters, the
Vice-President shall become the President to serve the unexpired term. In
case of death, permanent disability, removal from office, suspension, or
resignation of both the President and the Vice-President, the Council member
elected by the Councilors from among themselves shall then act as President.
Section 10. Whenever there is a vacancy in the Office of the Vice-president
during the term for which he/she was elected, the vacant officer shall be filled
through a special election duly called for the purpose by the CPSS Council, or
through an election conducted by the Councilors from among themselves, as
the case may be.
Section 11. There shall be elected two batch representatives who shall serve as
the voice of the year level councils they represent, and shall bring the interest
of their respected year levels to the Council, and shall have voting powers in
the Council and its sessions; they shall serve their year level council
responsibly.
Section 11. During summer term, vacant positions shall be filled in by
incumbent officers who come next in the hierarchy. These incumbent officers
shall continue to exercise their respective functions and duties until the new
set of officers shall have been elected.

ARTICLE X
COMMITTEES
Section 1. There shall be nine (9) Standing Committees with the following
functions:
a. Academics. It shall have the primary task of carrying out the intellectual
activities of the Society.
b. Finance. It shall assume the responsibility of handling and managing the
Society’s funds. It shall collect, safeguard, disburse and make reports of the
Society’s funds.
(1) The Finance Committee’s co-chairman, to be appointed by the
President from the Council, shall serve as the Auditor. He shall examine and
audit expenditures and uses of funds of the Society and shall be held
responsible for the properties owned or held in trust by the Society.
c. Spiritual. It shall undertake activities pertaining to the spiritual upliftment of
the members of the Society.
d. Socio-cultural. It shall initiate programs aimed to promote the social and
cultural aspects of the members of the Society, and to discover and/or
enhance the skills and talents of the same.
e. Civics. It shall come up with projects and activities that shall encourage the
participation and involvement of the members in community-awareness and
development.
f. Health and Environment. It shall the task of promoting the physical well-
being of the members, as well as providing an ecological balance between the
Organization and nature.
g. Information. It shall disseminate information regarding the activities,
programs and reports of the Society. It shall assume the public relations
functions of the Society.
i. Complaints and Grievances. It shall handle the investigation regarding
petitions for impeachment of officer/s. It shall receive reports, complaints and
grievances submitted to it by any member of the Society. It shall investigate
disputes referred to the Society and give recommendation to the Advisory
Body, if it may deem necessary. It shall perform other functions that the
Society may deem necessary for its operations.
j. Alumni Relations. It shall oversee functions and matters concerning the
Organization’s relations with the alumni of the Department of Political
Science.
(1) This Committee shall automatically be held by the duly elected Vice-
President upon his ascendancy into office.
Section 2. No member of the Council may hold two Standing Committee
chairmanships at the same time.
Section 3. It shall be the primary duty of each committee is to ensure the
prosperity of all members of the council.

ARTICLE XI
Qualifications of Officers
Section 1. No person may be elected President or Vice-President unless he or
she is a bona fide member of the Society, taking up only AB Political Science,
with no failing remarks in any of the semesters of his enrollment in the
academic program and has been a resident of the Department of Political
Science of the University of San Carlos for at least four (4) regular semesters.
a. No person may be elected to any position stated in this section and
of Section 2 of this Article hereof if he or she has a pending case
before the University of San Carlos- Office of the Student Affairs
(OSA) with the probable punishment of suspension, expulsion, or
exclusion.
Section 2. No person may be elected Councilor unless he or she is a citizen of
the Philippines, a bona fide member of the Society, majoring only the course
AB Political Science.
Section 3. No person shall be elected Councilor Ex-Officio unless he belongs
to the track he or she is representing.

Article XII
TERM OF OFFICE
Section 1. All officers shall have a term of office of one (1) school year.
Section 2. The President and Vice-President shall not be eligible for any re-
election for the same office.
Section 3. The Batch Representatives, Councilors and Councilors Ex-Officio
shall be entitled to one (1) possible re-election for the same office.

Article XIII
ACCOUNTABILITY OF OFFICERS
Section 1. Public office is a public trust. Officers must at all times be
accountable to the Political Science Majors, must serve them with utmost
responsibility, integrity and efficiency.
Section 2. The President, the Vice-President and all the Councilors may be
removed from office by impeachment based on the following grounds: grave
violation of the CPSS Constitution, incompetence, grave abuse of power,
gross negligence of duty, graft and corruption, gross misconduct, and
unreasonable absences of major activities of the Society.
Section 3. The impeachment proceedings shall be conducted in the following
manner: A petition paper with a signature of at least twenty percent (20%) of
the total number of members of the Society shall be submitted to the
Committee on Complaints and Grievances. The Committee shall then conduct
proper investigation on the matter and insure that due process is observed.
The findings shall then be submitted to the CPSS Council. For an officer to be
impeached, a two-thirds (2/3) vote of all the members of the Society shall be
required through secret balloting.

Article XIV
ADVISORY BODY
Section 1. There shall be an Advisory Body that shall serve as the arbiter of
disputes referred to it by the Society concerning the interpretations and/or
applications of provisions of the Constitution.
Section 2. The Advisory Body shall be composed of three (3) faculty members
of the Political Science Department, with the proper recommendation from
the Department Chair.
Section 3. The Adviser of the Society, who is appointed by the Chairperson of
the Political Science Department, shall serve as the Chairperson of the
Advisory Body. He/she shall then appoint the members of the said Body,
giving due preference to those having background in the field of law.

Article XV
ELECTION
Section 1. The election of officers shall be held two weeks after the general
elections of the Supreme Student Council of the University of San Carlos.
Section 2. There shall be a campaign period of four (4) days which shall end a
day before the election. The day before the elections should be a silent period
and any secret campaigning is strictly prohibited.
Section 3. Guidelines pertaining to the registration and accreditation of
parties, the campaign period, and the election proper shall be issued by the
CPSS Commission on Elections (COMELEC) in due time.
Section 4. The election of officers shall be done by secret balloting, unless
otherwise provided.
Section 5. A special election shall be done for the election of first year batch
representatives, which shall be done at most two weeks after the start of
every academic year.

Article XVI
COMMISSION ON ELECTIONS
Section 1. There shall be a Commission on Elections (COMELEC) which shall be
headed by the Adviser of the Society.
Section 2. The members shall be from among the faculty members of the
Department of Political Science. The Secretary of the Department shall be the
Secretary of the Commission.
Section 3. The Commission shall exercise the following powers and functions:
a. Enforce and administer all laws and regulations relative to the conduct of
an election, plebiscite, and referendum;
b. Exercise exclusive original jurisdiction over all contests relating to the
election returns and qualifications of all candidates;
c. Decide, except those involving the rights to vote, all questions affecting
elections; and
d. Register all contending parties or independent candidates, including each
party’s line-up of candidates; their platform/programs of government, and
calendar of activities.
e. Issue the Guidelines pertaining to the registration and accreditation of
parties, the campaign period, and the election proper
f. Ensure that all running candidates have not been found of any pending case
before the Office of the Student Affairs or from any court in the Philippines
thereat
Section 4. A multi-party system shall be adopted.

Article XVII
MEETINGS
Section 1. A general assembly shall be convened by the President upon the
start and at the end of every semester to update the members of the Society
of the Council’s dealings and reports.
Section 2. The Council shall meet twice a month in the manner prescribed for
in Article VIII of this Constitution. Special meetings may be called by the
President at any time or upon the written request of at least one-fifth (1/5) of
the total regular membership of the Society.
a. The Committees shall meet once a month, with its proceedings to be
duly affirmed by the General Secretary.
Section 3. A majority of the regular members of the Society shall constitute a
quorum for the transactions of business.
Section 4. A majority of the members of the Council or any of Committee shall
constitute a quorum for the transactions of business within said bodies.
Section 5. Any member who fails to attend the regular meetings of the Society
without valid excuse shall be dealt with accordingly.
Section 6. Except as may be provided in the Constitution or by-laws and rules
of the Society, all its meetings shall be conducted in accordance with
parliamentary rules and procedures.
Section 7. Regular meetings shall be announced one (1) week prior to their
holdings. Special meetings shall be announced at least three (3) days prior to
the same.

Article XVIII
FEES AND FUNDS
Section 1. The Council shall be given the power to determine the amount of
the CPSS membership fee to be collected per semester as seen fit in response
to our economic status.
Section 2. Members failing to pay their dues shall be notified in writing by the
treasurer of their delinquency, and if dues are not paid thereafter, they shall
be dealt with accordingly.
Section 3. Special assessments may be levied any time in a manner prescribed
by laws.
Section 4. Fifty percent (50%) of the collected membership fees shall be
appropriated for the CPSS Official Publication.
Section 5. Fund release over One Hundred Pesos (Php 100.00) shall need the
approval of the CPSS Council.
Section 6. All fund releases of the treasurer shall be subject to auditing.
Article XIX
CPSS PUBLICATION
Section 1. There shall be an official CPSS Publication, whose name shall be
retained unless a subsequent amendment to this Constitution shall have been
made to this effect.
Section 2. The Publication shall be autonomous from the Society.
Section 3. Pursuant to the foregoing section, the Publication shall be governed
by a separate Charter. The said Charter shall be drafted by the Committee on
Publication for approval by the 1994-1995 Constitutional Commission.
Section 4. Provisions of the duly approved Nexus Charter shall be binding and
executory on matters concerning the said Publication, and shall remain so
unless a subsequent amendment to the Charter shall have been made.

Article XX
AMENDMENTS AND REVISIONS
Section 1. Any amendments to this Constitution may be proposed by the
Council upon three-fourths (3/4) vote of all its members, or two thirds (2/3)
vote in the General Assembly, provided that each District is duly represented
by at least twenty percent (20%) of its total population.
Section 2. A revision of this Constitution may be done through a Constitutional
Convention duly created for the said purpose by a two-thirds (2/3) vote of the
General Assembly.
Section 3. Any amendments to, or revision of this Constitution shall be valid
and effective when ratified by a majority votes cast in a plebiscite duly called
for the purpose not later than two weeks after such amendments or revisions
have been approved.

Article XXI
TRANSITORY PROVISIONS
Section 1. The first election of the CPSS Officers under this Constitution shall
be held on the second week of March, School Year 2016-2017. If, however, the
Organization has yet to approve this Constitution through a plebiscite by that
date, the elections for the CPSS Officers shall be done on the third week of
February, School Year 2017-2018.
Section 2. An increase in the CPSS Fee shall be deliberated by the Council for
the School Year 2017-2018 and 2018-2019, given the perceived low population
on those times.
Section 3. Vacant positions shall be filled in by the incumbent officers who
come next in the hierarchy. These incumbent officers shall continue to
exercise their respective functions and duties until the first set of officers shall
have been elected.
Section 4. This Constitution shall be presented to the Organization in the
manner prescribed by the Council or any of its members, through a general
assembly or on other fora. All members may propose amendments and be
clarified of certain matters on this forum.
Section 5. Upon the approval of this Constitution, there shall be created a By-
laws Committee, the structure, members and their election, and other
pertinent details to be decided by the Council, or of this present Constitutional
Convention body.
Section 6. All members of this Organization shall be secured a photocopied
document of this Constitution, including the names of the members of the
Constitutional Convention.
Section 7. This Constitution shall take effect immediately upon its ratification
by a majority votes cast in a plebiscite held not later than forty-five (45) days
after the submission of the draft to the CPSS Executive Committee.
MANIFESTO OF THE 2016 CONSTITUTIONAL CONVENTION
Know all men by these presents:
WHEAREAS, by virtue of the Resolution of the CPSS, the 2016 CONSTITUTIONAL
CONVENTION (herein CONCON) was rightfully convened on August 27, 2016;

WHEREAS, on the first session, the House Rules of the CONCON and its set of officers
was elected;

WHEREAS, thereafter, or from 2016 to 2017, we served as the delegates of our


respective councils for the CONCON;

WHEREAS, the CONCON has held a series of meetings and deliberations, and various
resolutions were filed for the purpose of revising the 2012 CPSS Constitution;

WHEREAS, by a vote of 11-5 on the Third Reading, this Constitution was adopted by

WHEREAS, after a series of consultations with the faculty of the Department of


Political Science, this Constitution was published for the Political Science majors;

WHEREAS, of the 132 votes casted, with an overwhelming majority of 107 “YES” votes,
this Constitution was approved by the Political Science majors and has took effect on
March 21, 2017;

IN VIEW THEREOF, WE, the members of the 2016 Constitutional Convention, hereby
dispense with our official functions as delegates of the CONCON and concur to its
adjournment;

FURTHERMORE, WE, the members of the CONCON hereby certify that we have read
the contents of this Constitution and certify further that we approve of all of its
contents;

FURTHERMORE, WE, the members of the CONCON hereby expect that this
Constitution serve the best interest of the CPSS and WE hope that this serves as a
legacy for the CONCON to bestow upon the future members and officers of the
Carolinian Political Science Society.

WE respectfully submit this to the Department of Political Science and the Political
Science majors.
